Section 21-18.1. <br /> <br />Selling of illegal stimulants to minors <br />prohibited. <br /> <br /> It shall be unlawful for any person to knowingly sell <br />to a minor any pill; capsule or tablet containing any com- <br />bination of caffeine and ephedrine sulfate. <br /> <br /> A Vic~lation of this section shatlbe punishable as <br />Class 1~ misdemeanor- <br /> <br />Section 21-18.2. <br /> <br />Selling of certain substances <br />to minors constitutes a nuisance. <br /> <br /> The~sale or distribution of any imitation controlled <br />substance as defined in Section 21-8 or any pill, capsule, or. <br />tablet containing any combination of caffeine or ephedrine <br />sulfate to a person under the age of eighteen (18) years of <br />age, shall constitute a nuisance detrimental to the health, <br />safety and welfare of the residents of the City. <br />Section 21-18.3. Pharmac±st required for certain businesses <br /> selling proprietary medicines. <br /> <br /> (a) The owner or proprietor of any establishment which <br />has gross sales Of proprietary medicines or non-prescription or <br />oven-the-counter drugs, exceeding seventy-five percent (75%) <br />of total gross sales shall employ a registered pharmacist on <br />the premises during business hours. <br /> (b) The owner or proprietor of each such establishment <br /> shall keep at his place of business a complete, accurate and <br /> legible· record of all transactions.' This record shall clearly <br /> set forth ~ description of all substances p~rchased and sold, <br /> the date of each purchase and sale, and eack purchaser's name <br /> and address. Such record shall be retained by the owner or <br /> proprietor for not less than twenty-four months from %he date <br /> of each sale. <br /> (~c) Anyperson who violates any provision of this section <br /> shall be g~ilty of a Class 1 misdemeanor. Each sale transacted <br /> while an establishment is ±n violation of' th~S section shall ·~on- <br /> stitute a separate offense. <br /> <br /> 2. That Section 21-18 of the Code of the City of <br /> Portsmouth, Virginia, 1973, be repealed. <br /> <br /> 3. That Sections 21-19, 21-20 ~b), 21-20 Id), 21-21, <br /> 21-22 and 21-24 of the Code of the City of Portsmouth, Virginia, <br /> 1973, be amended and reordained to read as follows: <br /> <br /> <br />
