AN ORDINANCE TO AMEND THE CODE OF THE CITY OF PORTSMOUTH, <br />VIRGINIA, 1973, BY AMENDING SECTIONS 23-73(a) AND 32-16 <br />THEREOF, PERTAINING TO RIDING ON THE SIDEWALKS. <br /> <br /> BE IT ORDAINED by the Council of the City of Portsmouth, <br />Virginia: <br /> <br /> 1. That Sections 23-73 (a) and 32-16 of the Code of the <br />City of Portsmouth, Virginia, 1973, be amended and reordained <br />to read as follows: <br /> <br />Section 23-73. Riding on sidewalk. <br /> <br /> (a) Subject to section 32-16, if any person rides or <br />drives any vehicle other than a bicycle on the sidewalks of <br />the city, or rides a bicycle on sidewalks or crosswalks <br />designated as prohibiting the riding of bicycles, he shall be <br />guilty of a traffic infraction and upon conviction shall be <br />fined not less than five dollars ($5.00) nor more than <br />twenty-five dollars ($25.00). <br /> <br />Section 32-16. ProtectIon of sidewalk when crossing. <br /> <br /> No person shall cross a sidewalk with any vehicle, <br />except over a properly constructed driveway, without first <br />protecting such sidewalk from injury by laying heavy boards <br />thereon. Any violation of this section shall constitute a <br />traffic infraction and shall be punishable by a fine of not <br />less than five dollars ($5.00) and not more than twenty-five <br />($25.00). <br /> <br /> If any damage is done to the sidewalk by reason of its <br />not being protected in the manner prescribed, the offender <br />shall also pay for the cost of all repairs to the same in <br />addition to any fine that may be imposed for the violation <br />hereof. <br /> <br /> 2. This ordinance shall take effect on the date of its <br />adoption. <br /> <br /> Adopted by the Council of the City of Portsmouth, <br />Virginia, at a meeting held April 22, 1986. <br /> <br />Teste: <br /> <br />City Clerk <br /> <br /> <br />
