1986-30 <br /> <br />AN ORDINANCE TO AMEND THE CGDE OF THE CITY OF PORTSMOUTH, <br />VIRGINIA, 1973, BY AMENDING SECTION 24-86 THEREOF, <br />PERTAINING TO POSSESSION AND CONSUMPTION OF ALCOHOLIC <br />BEVERAGES, ETC. IN ANY CITY PARK, ETC. <br /> <br /> BE IT ORDAINED by the Council of the City of <br />Portsmouth, Virginia: <br /> <br /> 1. That Section 24-86 of the Code of <br />Portsmouth, 1973, be amended and meordained <br />follows: <br /> <br />the City of <br />to read as <br /> <br />Section 24-86. <br /> <br />Possession, consumption of alcoholic <br />beverages, drugs, controlled substances <br />or any other intoxicating substance. <br /> <br /> Possession and/or consumption of alcoholic beverages, <br />drugs, or controlled substances as defined in §54-524.2(6) <br />of the Code of Virginia, as amended, or any other <br />intoxicating substance in any part of any city park, <br />recreation area, or playground area, ts prohibited except as <br />noted herein. No person shall enter or be in any park or <br />recreation area or playground area while under the influence <br />of alcoholic beverages, drugs, any controlled substance, or <br />any other intoxicating substance. Alcoholic beverages may <br />be consumed and/or served in areas designated as "Closed to <br />the Public" and by persons with permission from the city <br />manager, and who are in possession of the appropriate <br />Virginia Alcoholic Beverage Control Board permits. <br /> <br /> Any violation of these prohibitions as to the <br />possession or consumption of alcoholic beverages, the <br />entering or being in aDy park, recreation area or playground <br />area while under the influence of alcoholic beverages, <br />drugs., any controlled substance, or any other intoxicating <br />substances, or the consumption or serving of alcoholic <br />beverages without permission of the city manag~r-or without <br />the appropriate V~.rg~nla'Ai~eoho~ti~~ Beverage Control Board <br />permit sha~l. De punishable .as a Class 4 misder~eanor. All <br />other violations of this section shall be punished in <br />accordance with the penalties prescribed in Chapter 21, <br />Article II of this Code. <br /> <br /> 2.
