ZONING AMENDMENT ORDINANCE Z~86-16 <br /> <br /> BE IT ORDAINED by the Council of the City of <br />Portsmouth, Virginia: <br /> <br /> 1. '~hat a portion of the Zoning Map attached to <br />and made a part of the Zoning Ordinance of the City of <br />Portsmouth, Virginia, 1973, which now zones as Historic <br />Residential (HR) the property described in Petition to <br />Zoning Amendment No. Z-86-16 is hereby amended and <br />changed so as to show said property zoned as Historic <br />Limited Business Conditional (HLB-K). <br /> <br /> 2. The property affected by this ordioance is <br />described as follows: <br /> <br />Z-86-16 <br /> <br /> BEGINNING at the southeast corner of <br />Crawford Parkway and Elm Avenue; thence <br />east along the south right-of-way of Craw- <br />ford Parkway 57'~; thence south 116'; <br />thence west 57'+ to the east right-of-way <br />of Elm Avenue; ~hence north along said <br />right-of-way 116' to the Crawford Parkway, <br />the Point of Origin. <br /> <br /> 3. Zoning Amendment Ordinance Z-86-16 is <br />conditioned upon the following as proffered by the <br />petitioners: <br /> <br /> (a) The use of the property will be limited <br />to "antique and gift sales" and "dairy bars and ice <br />cream manufacture for retail sale on the premises only" <br />and residential uses as permitted in ~40-102 (I) (1). <br /> <br /> (b) The commercial use as provided for in <br />subparagraph (a) above will be limited to the space <br />originally designated for commercial use (front 1000 <br />square feet of the first floor). <br /> <br /> (c) If the existing historic structure is <br />damaged by fire or other causes to an extent prohibiting <br />reconstruction in accordance with §40-36 of the City <br />Code and/or its ~e~cunstruction or renovation results in <br />an alteration of its original design then the zoning <br />designation will revert back to Historic Residential HR. <br /> <br /> <br />
