(e) Section ES-302.1 General, is amended to read as <br /> follows: <br /> <br />Section ES-302.1. General: <br /> <br /> The exterior of a structure shall be maintained in good <br />repair, structurally sound and sanitary so as not to pose a <br />threat to the health,'safety or welfare of the occupants and <br />so as to protect the occupants from the adverse affects of the <br />environment. It shall be unlawful for the owner or occupant <br />of a residential building, structure or property to utilize <br />the premises of such residential property for the open storage <br />of any appliance, debris, glass, building material, building <br />rubbish or similar items. It shall be the duty and <br />responsibility of every such owner or occupant to keep the <br />premises of such residential property clean and to remove from <br />the premises all such appliances, debris, glass, building <br />materials, building rubbish as listed above, including but not <br />limited to weeds, dead trees, trash, garbage, etc,, upon <br />notice from the Code official. <br /> <br />Section 17-19. Same- definitions. <br /> <br /> (a) Where the words "local governing body', "local <br />government", or "enforcing agency' are used in the Building <br />Maintenance Code, hereby adopted, they shall be held to mean <br />the City of Portsmouth, Virginia. <br /> <br /> (b) Where the words "Code official" are used in the <br />Building .Maintenance Code, hereby adopted, they shall be held <br />to mean the Director of Housing Services and Community <br />Development, who is hereby designated to enforce said Code. <br /> <br /> (c) The word "debris" shall mean: Dead or dying <br />standing weeds, trash, junk, discarded or abandoned parts of <br />vehicles, appliances or machinery, or any other material or <br />substance which may provide a harbor for snakes or rats or <br />anything or any condition which may be a fire menace or <br />breeding place for mosquitoes, give off obnoxious or offensive <br />odors, or endanger the health or safety of the residents of <br />this City. <br /> <br />Section 17-23. Penalties. <br /> <br /> Any person, firm, corporation or agent who violates or <br />fails to comply with the provisions of this Article shall bbe <br />guilty of a misdemeanor. Each violation of a separate and <br />distinct provision of this Article shall be made a separate <br />offense and each such offense shall be punishable by a fine of <br />not more than One Thousand Dollars ($1,000.00). Each day any <br />violation of this Article shall continue shall constitute a <br />separate offense. <br /> <br /> <br />
