AN ORDINANCE TO AMEND THE CODE OF THE CITY OF PORTSMOUTH, <br />VIRGINIA, BY ADDING SECTION 4-28 TO CHAPTER 4 THEREOF <br />PERTAINING TO DOGS. <br /> <br /> BE IT ORDAINED by the <br />Virginia, that the Code of <br />1973~ by amended by adding <br />follows: <br /> <br />Council of the City of Portsmouth, <br />the City of Portsmouth, Virginia, <br />thereto Section 4-28 to read as <br /> <br />Section 4-28. Dogs littering public places. <br /> <br /> It shall be unlawful for any owner or person in control <br />of a dog to: <br /> <br /> (1) Knowingly or willfully allow his/her dog to urinate <br />or defecate on the private property of other persons without <br />their consent or that of the authorized agent of the one <br />having connrol of the premises~ <br /> <br /> (2) Knowingly or willfully allow his/her dog to defecate <br />on public property, except that defecation by a dog on public <br />property shall not constitute a violation of this section if <br />the owner of the dog immediately removes the material defected <br />and disposes of it in a safe and sanitary manner. <br /> <br /> Any person who violates the provisions of this section <br />shall be'guilty of a Class 4 misdemeanor. <br /> <br /> Adopted by the Council of the City of Portsmouth, <br />Virginia, at a meeting held September 9, 1986. <br /> <br />Teste: <br /> <br />City Clerk <br /> <br /> <br />
