1986 88 <br /> <br />AN ORDINANCE AMENDING ORDINANCE NO. 1986-80 PERTAINING TO <br />"THE CONVEYANCE"BY THE CITY OF ANY RIGHT, TITLE AND INTEREST <br />OF THE CITY IN A PORTION OF.ELLIOTT AVENUE CLOSED THEREBY. <br /> <br /> WHEREAS, the Council of the City of Portsmouth, <br />Virginia on July 22, 1986 adopted Ordinance No. 1986-80 <br />which c%osed and vacated as a public street a ceDtain <br />portion of Eltiott Avenue as described therein and <br />authorized the City Manager to convey any right, title and <br />interest of 'the City in and to the described portions of <br />said street to the abutting property owners for a specified <br />value; and <br /> <br /> WHEREAS, the Council of the City of Portsmouth n <br />Virginia has received a request from representative~ of <br />abutting property owners with regard to the'method of <br />conveyance of the right, title and interest of the City <br />therein; and <br /> <br />the <br /> <br /> WHEREAS, after due consideration of the unusual <br />circumstances surrounding the dedication of Elliott Avenue <br />and the benefits to be derived by the Cit~ from the <br />development of those portions of land adjoining Elliot~ <br />Avenue the Council is of the opinion that a revision of the <br />conditions of conveyance is in the best interest of the <br />City and its citizens. <br /> <br /> NOW, THEREFORE, BE IT ORDAINED by the Council of the <br />City of Portsmouth, Virginia that Ordinance No. 1986-80 as <br />adopted on July 22, 1986 be, and hereby is, amended with <br />respect to the conveyance of any right, title and interest <br />of the City in a~d to the described port~ns of said street <br />to be closed, such amended section to read as follows: <br /> <br /> BE IT ORDAINED that the City Manager be, and he hereby <br />· s, authorized to convey any right, title and interest of <br />the City in and to the described portions of Elliott Avenue <br />closed in Ordinance No. 1986-80 to the abutti.ng property <br />owners under such-~terms and conditions as may be deemed <br />acceptable to the City. ~ <br /> <br /> BE IT FURTHER ORDAINED that all remaining provisions <br />of Ordinance No. 1986-80 remain ~n full force and effect as <br />of the date of the adoption of Ordinance No. 1986-80. <br /> <br /> This ©rdinance shall take effect from the da~e of its <br />adoption. <br /> <br /> <br />
