AN ORDINANCE TO <br />VIRGINIA, 1973, <br />TO DOGS. <br /> <br />AMEND THE CODE OF THE CITY OF PORTSMOUTH, <br />BY AMENDING SECTION 4-23 THEREOF, PERTAINING <br /> <br /> BE IT ORDAINED by the Council of the City of Portsmouth, <br />Virginia, that Section 4-23 of the Code of the City of <br />Portsmouth, Virginia, 1973, be amended to read as follows: <br /> <br />Section 4-23. Running at large. <br /> <br />(a) <br /> <br />It shall be unlawful for any person who owns, keeps, <br />or harbors a dog or has it in his care, or who acts <br />as its custodian, or who permits a dog to remain on <br />or about a premises occupied by him, to allow such <br />dog to run at large unless such dog is accompanied <br />by an attendant, and held leashed by a responsible <br />person or securely muzzled with a muzzle, the <br />character of which shall have been approved by the <br />animal warden or animal control officer of the <br />City of Portsmouth. <br /> <br />(b) <br /> <br />For the purpose of this section, a dog shall be <br />deemed to run at large while roaming, or self- <br />hunting off the property of its owner or custodian <br />and non under its owner's or custodian's immediate <br />control. Any person who permits a dog to run at <br />large or remain unconfined, unrestricted or not <br />penned;~up~..~sha~L~be deemed-:to-~v~-w~otated the <br />provis±ons'~of this'section, a~d Shall be guilty <br />of a Class IV misdemeanor. <br /> <br />(c) It shall be unlawful for any person who owns or <br /> ~has control of any dog to allow such dog to ride in <br /> ~:~,a~y motor vehicle ~in any po~ion ~hereof. that .is <br /> ::..epen in such a manner as to permit such dog to jump <br /> -out of the v~hicle:or to be thrown therefrom by <br /> acceleration~of.~ ~t~pping of,, oraceident inv~l~ing, <br /> such vehicle. The prohibited portion of a motor <br /> vehicle shall include, but not be limited to, the <br /> open bed of a truck, the interior of a convertible <br /> vehicle with the top down, or removed, the rear <br /> storage portion of a station wagon with the tailgate <br /> open, and the trunk or hatchback portion of any <br /> vehicle with the trunk or hatchback open. For the <br /> purpose of this subsection, the operator of a motor <br /> vehicle shall be deemed to have control of any dog <br /> ri~ing ~herein. <br /> <br />~he provisions' of this subsection shall not apply <br />to: <br /> <br /> <br />
