44 A RESOLUTION AUTHORIZING THE CITY MANAGER TO CONVEY CERTAIN REAL PROPERTY TO THE CITY OF SUFFOLK. WHEREAS, the City of Portsmouth owns certain real property located in the City of Suffolk, which property is no longer required for public utility purposes and is, hereby, declared to be excess property; and WHEREAS, the City of Suffolk desires to acquire a portion of said property in order to construct a sewage pumping station; and WHEREAS, the City of Suffolk has agreed independently appraised value of said parcel $500.00; and to pay the in the amount of WHEREAS, Section 2.09(c) of the Charter of the City of Portsmouth provides that the City may convey property to the Commonwealth of Virginia or a political subdivision thereof without advertisement and receipt of bids; and WHEREAS, the City of Suffolk is a political subdivision of the Commonwealth of Virginia. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia, that the City Manager be, and he hereby is, authorized to convey to the City of Suffolk, upon receipt of the payment of the appraised value, the following described property, to-wit: Ail that certain piece or parcel of land, situate, lying and being in the City o~ Suffolk, Virginia, bounded and described as follows: beginning at a point on the southern boundary of Faulk Road, said point being the point of intersection of the southern boundary of Faulk Road and the boundary of Lots 8 and 9 as shown on that certain plat entitled "Plat of P'inaire Subdivision" recorded in the Clerk's Office of the Circuit Court of the City of Suffolk (formerly Nansemond County) in Deed Book 9, page 31; thence continuing along the southern boundary of Faulk Road along a curve to the left for a distance of 32.33' to the TRUE POINT OF BEGINNING; thence continuing along the boundary of Faulk Road from the TRUE POINT OF BEGINNING along a curve to the left
