36 <br /> <br />A RESOLUTION AUTHORIZING THE CITY MANAGER TO ENTER INTO AN <br />EASEMENT AGREEMENT WITH THE CITY OF SUFFOLK FOR INSTALLATION <br />OF A SANITARY SEWER. <br /> <br /> WHEREAS, the City of Portsmouth owns certain real <br />property located in the Oak Ridge area of the City Suffolk; <br />and <br /> <br /> WHEREAS, the City of Suffolk <br />facilities in this area, and has <br />such purposes on the property of <br /> <br /> is installing sanitary sewer <br />requested an easement for <br />the City of Portsmouth; and <br /> <br /> WHEREAS, the installation of sanitary sewers would reduce <br />the problems of malfunctioning septic tanks and drainage into <br />the Lake Speight watershed; and <br /> <br /> WHEREAS, the City of Suffolk will install the sewer in <br />accordance with acceptable standards for sedimentation and <br />erosion control as required by law and will pay the cost of <br />surveying and engineering for said construction. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED, by the Council of the <br />City of Portsmouth, Virginia, that the City Manager be, and <br />hereby is, authorized to enter into an Easement Agreement with <br />the City of Suffolk for installation of a sanitary sewer <br />over, under and across the following described property, <br />to-wit: <br /> <br /> Ail that certain piece or parcel of land, <br />situate, lying and being in the City of Suffolk, <br />Virginia, shown on that certain plat entitled "Plat <br />of 15' Utility Easement The City of Suffolk" dated <br />August 31, 1985, prepared by Waid Kidd, Jr., said <br />parcel being designated as "proposed easement" and <br />extending along the southern boundary of the <br />property of the City of Portsmouth as shown on said <br />plat as the same adjoins th~ right-of,way of U.S. <br />Route 58. <br /> <br /> BE IT FURTHER RESOLVED that the said Easement <br />Agreement shall be subject to the inclusion of <br />acceptable sedimentation and erosion control provisions <br />in the construction contract and restoration of the <br />subject property to its present condition upon <br />completion of construction. <br /> <br /> Adopted by the Council of the City of Portsmouth, <br />Virginia, at a meeting held March 25, 1986. <br /> <br />Teste: <br /> <br />City Clerk <br /> <br /> <br />
