36 A RESOLUTION AUTHORIZING THE CITY MANAGER TO ENTER INTO AN EASEMENT AGREEMENT WITH THE CITY OF SUFFOLK FOR INSTALLATION OF A SANITARY SEWER. WHEREAS, the City of Portsmouth owns certain real property located in the Oak Ridge area of the City Suffolk; and WHEREAS, the City of Suffolk facilities in this area, and has such purposes on the property of is installing sanitary sewer requested an easement for the City of Portsmouth; and WHEREAS, the installation of sanitary sewers would reduce the problems of malfunctioning septic tanks and drainage into the Lake Speight watershed; and WHEREAS, the City of Suffolk will install the sewer in accordance with acceptable standards for sedimentation and erosion control as required by law and will pay the cost of surveying and engineering for said construction. NOW, THEREFORE, BE IT RESOLVED, by the Council of the City of Portsmouth, Virginia, that the City Manager be, and hereby is, authorized to enter into an Easement Agreement with the City of Suffolk for installation of a sanitary sewer over, under and across the following described property, to-wit: Ail that certain piece or parcel of land, situate, lying and being in the City of Suffolk, Virginia, shown on that certain plat entitled "Plat of 15' Utility Easement The City of Suffolk" dated August 31, 1985, prepared by Waid Kidd, Jr., said parcel being designated as "proposed easement" and extending along the southern boundary of the property of the City of Portsmouth as shown on said plat as the same adjoins th~ right-of,way of U.S. Route 58. BE IT FURTHER RESOLVED that the said Easement Agreement shall be subject to the inclusion of acceptable sedimentation and erosion control provisions in the construction contract and restoration of the subject property to its present condition upon completion of construction.
