A RESOLUTION GRANTING A USE PERMIT TO CALVARY EVANGELICAL BAPTIST CHURCH TO OPERATE A CHURCH AND PLACE OF WORSHIP AT 205 GUST LANE. WHEREAS, Calvary Evangelical Baptist Church, by Allen R. McFarland, Pastor, and Messrs. Jones, Duncan and Fate, Trustees, have made application pursuant to ~40-71 (b) of the Code of the City of Portsmouth, Virginia, 1973, for the granting of a use permit as hereinafter described; and WHEREAS, the applicant and the done all things required to be done application; and Planning Director have in connection with said WHEREAS, the Planning Commission has recommended the granting of said use permit. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: 1. That the use for which the use permit hereinafter described is sought: (a) Will not adversely affect the health and safety of persons residing or working in the neighborhood of the proposed use; or injurious neighborhood; (b) Will not be detrimental to the public use to the property and improvements in the and (c) Will be in accordance with the purposes of the Zoning Chapter of the City Code. 2. Calvary Evangelical Baptist Church is hereby granted a use permit pursuant to'r~40-71'(~b) of the Code of the City of Portsmouth., Virginia, to operate a church and place of worship, including educational buildings, on the property designated as 205 Gust Lane (Tax Map 490, Parcel 2), which parcel contains 1.75 acres and is more particularly described as follows: UP-85-36 BEGINNING at the northwest intersection of Gust Lane and Avondale Road; thence north- westerly along the west right-of-way of Gust Lane 440' +; thence southwesterly 220' to the east right'of-way of Avondale Road; thence southeasterly 275' + to the north right-of- way of Avondale Roa~; thence easterly along said right-of-way 330' + to Gust Lane, the Point of Origin.
