A RESOLUTION GRANTING A USE PERMIT TO Z. L. LANGLEY FOR THE <br />CONVERSION OF AN EXISTING VACANT COMMERCIAL STRUCTURE TO A DUPLEX <br />RESIDENCE AT 349-51 MARYLAND AVENUE (UP-85-33). <br /> <br /> WHEREAS, Z. L. Langley, has made application pursuant to <br />Section 40-102 (B) for a use permit to convert an existing vacant <br />commercial structure to a duplex residence at 349-51 Maryland <br />Avenue which is located in the Port Norfolk Historic District; and <br /> <br /> WHEREAS, the applicant and the Planning Director have done <br />all things required to be done in connection with said <br />application; and <br /> <br /> WHEREAS, the Planning Commission has recommended the <br />granting of a use permit with conditions for the conversion of an <br />existing vacant commercial structure to a duplex residential <br />structure. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City <br />of Portsmouth, Virginia: <br /> <br />1. That the use for which the use permit is sought: <br /> <br /> (a) Will not adversely affect the health and safety of <br />persons residing in the neighborhood of the proposed use; <br /> <br /> (b) Will not be detrimental to the public use or <br />injurious to the property or improvements in the neighborhood; and <br /> <br /> (c) Will be in accord with the purposes of the Zoning <br />Chapter of the City Code. <br /> <br /> 2. Z.L. Langley is hereby granted a use permit pursuan5 <br />to Section 40-102 (B) to convert an existing vacant commercial <br />structure to a duplex residential structure at 349-51 Maryland <br />Avenue, such conversion to be in compliance with the regulations <br />applicable to the Port Norfolk Historic Residential Subdistrict as <br />provided for in the Zoning Chapter of the Code of the City of <br />Portsmouth, Virginia, 1973, as amended, such approval being <br />granted subject to the following terms and conditions: <br /> <br /> (a) The applicant shall comply with all applicable <br />codes, ordinances, policies and regulations of the City of <br />Portsmouth, Virginia, and shall obtain all necessary licenses and <br />permits. <br /> <br /> (b) The applicant shall comply with the approval of <br />the Commission of Architectural Review in all its detail. <br /> <br /> This resolution shall take effect immediately upon its <br />adoption. <br /> <br /> <br />
