A RESOLUTION GRANTING A SPECIAL EXCEPTION TO A <br />'COMMERCIAL/OFFICE DEVELOPMENT AT 601 HIGH STREET FOR <br />OFF-STREET'PARKING IN THE DOWNTOWN D-l-DISTRICT. <br /> <br />121 <br /> <br /> WHEREAS, Michael D. Smith has made application for <br />the granting of a special exception to the off-st~eet <br />parking requirements for a commercial/office development <br />at 601 High Street pursuant to ~40-121 (b) (IV) in the <br />Downtown D-1 District; and <br /> <br /> WHEREAS, the applicant and-the Planning Director <br />have done all things required to be dore in connection <br />with-said application; and <br /> <br /> WHEREAS, the Planning.Commission has made a <br />recommendation for the granting of a special exception- <br />to the off-street parking requirements. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of <br />the City of Portsmouth, Virginia: <br /> <br />(1) That the special exception to be granted: <br /> <br /> (a) Will not adversely affect <br />safety of persons residing or working in <br />neighbcrhood; <br /> <br />the health and <br />the <br /> <br /> (b) Will not be detrimental to the public <br /> or injurious to the property or improvements in the <br />-n~e~ghborhood; and <br /> <br />use <br /> <br /> (c) Will be in accord with the purposes and <br />objectives of the Downtown D-1 District and the Zoning <br />Chapter of the City Code. <br /> <br /> 2. The commercial/office development to be <br />constructed at 601 High Street (southwest corner of <br />Washington and High Streets) is hereby granted a special <br />exception to the off-street parking requirements in the <br />Downtown D-1 District as prow[ded for in ~40-121 (b) <br />(IV) by the granting of a variance of all required <br />parking spaces, such special exception ~eing approved <br />subject to the following conditions: <br /> <br /> (a) A two (2) story 5,000 square foot <br />office/commercial structure shall be constructed on the <br />site with nine (9) parking spaces located on the~site. <br /> <br /> (b) The variance is granted on the basis that <br />the development will be as described herein, and any <br />change from such proposed use will constitute the <br />expiration of the variance hereby granted. <br /> <br /> <br />
