3. This use permit is approved subject to the <br />following conditions: <br /> <br /> (a) The facility shall be limited to a m~ximum of <br />one hundred (100) residents at any one time. <br /> <br /> (b) A landscaping plan detailing (1) a passive <br />recreation area, and (2) plant species and their specific <br />locations on the site, shall ee submitted to the Planning <br />Department for review and approval. <br /> <br /> (c) An access easement in form approved by the <br />City Attorney duly executed, acknowledged and recorded in <br />the office of the Clerk of the Circuit Court of the City of <br />Portsmouth shall be obtained providing access to the site <br />through the parcel of property lying immediately west of the <br />site. <br /> <br /> (d) The applicant shall comply with all <br />applicable codes, ordinances, policies and regulations <br />federal, state and local governments. <br /> <br />of <br /> <br /> Adopted by the Council of the City of Portsmouth, <br />Virginia at a meeting held October 14, 1986. <br /> <br />Teste: <br /> <br />City Clerk <br /> <br /> <br />
