A REHOLUTION GRANTING APPROVAL FOR A GROUR~OUSING PROJECT <br />PURSUANT FO SECTION 40-55 OF THE CODE OF~THE CITY OF '- <br />PQ~$MOUTH, VIRGI~IA~- i~73, ON A .62 ACRE PARCEL BOUNDED ~Y <br />HIGH STREET.~N THE NORTH, WATER STREET ON THE EAST,'~A <br />PROPOSED PARKING GARAGE ON THE SOUTH, AND CRAWFORD STREET ON <br />THE WEST. <br /> <br /> WHEREAS, Portsmouth Parkside Development Associates has <br />made application pursuant to ~40-55 of the Code of the City <br />of Portsmouth, Virginia, 1973, as amended, for the granting <br />and approval of a group housing project consi-s~i~g of forty~ <br />(40) condominium units and 8,800 square feet of retail <br />commercial space on the ground floor within a five and <br />one-half story structure on a parcel bounded by High Street <br />on the north, Water Street on the east, Crawford Street on <br />the west and a proposed parking garage on the south,-such <br />group housing project having been designated as ~HP-86-5; and <br /> <br /> WHEREAS, the applicant has been de%ermined by the <br />Planning Commission to have met the requirements of ~40-55 of <br />the Code of the City of Portsmouth, Virginia,. 1973, as <br />amended; and <br /> <br /> WHEREAS, the Planning Commission has reviewed such <br />application and site plans submitted therewith and has <br />recommended a conditional approval ~f said application; <br /> <br /> WHEREAS, the developer has been informed that approval <br />of a group housing project pursuant to §40-55 gran~s only an <br />exemption from certain requirements for residences as stated <br />in said section and does not constitute a waiver-of any other <br />requirements embodied in the Subdivision Ordinance, Z~ni~ <br />Ordinance, Code of the City o~ Portsmouth, Virginia, or any <br />other applicable local, state or federal law or regulation; <br />and <br /> <br /> WHEREAS, the developer is aware that building permits or <br />any~other required permit will be issued only upon compliance <br />with the ordinances, laws, or regulations applicable thereto. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the <br />City of'Portsmouth, Virginia that the cesta.in group housing <br />project designated as GHP-86-5, and more specifically <br />described in correspondence from W. B. Meredith, II, Inc. <br />dated July 9, 1986, with enclosures, and as shown on plans <br />filed with the appropriate officials of the City of <br />Portsmouth, Virginia, such documentation and plans being made <br />a part hereof, is hereby granted apprgval subject to the <br />following terms and conditions: <br /> <br /> 1. A Certificate of Compliance must be obtained from <br />the Downtown D-1 Design Committee prior to the issuance of a <br />building permit.~ <br /> <br /> <br />
