A RESOLUTION AUTHORIZING THE CITY MANAGER TO ENTER INTO AN <br />AGREEMENT AMENDING THE AGREEMENT OF MAY 23, 1958, WITH THE <br />CITY OF SUFFOLK PERTAINING TO THE ESTABLISHMENT OF THE LAKE <br />MEADE RESERVOIR. <br /> <br /> WHEREAS, by agreement dated May 23, 1958, the City of <br />Suffolk granted to the City of Portsmouth a perpetual and <br />exclusive right, privilege and easement of right-of-way on <br />certain property known as "City Farm" for the purpose of <br />floo~ing said property with the waters of Lake Meade <br />Reservoir; and <br /> <br /> WHEREAS, by subsequent survey of the subject property it <br />has been determined that certain portions of the boundary~ <br />description as incorporated in the 1958 agreement should be <br />amended; and <br /> <br /> WHEREAS, said amendments to the boundary description will <br />not adversely affect the use of the.subject property by the <br />City of Portsmouth for the Lake Meade Reservoir; and <br /> <br /> WHEREAS, the City of Suffolk has further agreed to convey <br />tO the City of Portsmouth easements for ingress and egress and <br />utility easements to Portsmouth well site no. 3 to replace <br />existing easements which will be eliminated by construction of <br />the City of Suffolk tennis center; and . · · <br /> <br /> WHEREAS, the-City of Portsmouth shall no longer be <br />required to construct and maintain a fence around the "City <br />Farm Proper~y". <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City <br />of Portsmouth, Virginia, that the City Manager be, and he <br />hereby is, authorized to enter into an agreement amending the <br />agreement of May 23, 1958, with the City of Suffolk pertaining <br />to the establishment of the Lake Meade Reservoir. <br /> <br /> Adopted by the Council of the City of Portsmouth, <br />Virginia, at a meeting held July 22, 1986~ <br /> <br />Teste: <br /> <br />City Clerk <br /> <br /> <br />
