73 A RESOLUTION APPROVING A REVISION TO A GROUP HOUSING PROJECT APPROVED PURSUANT TO SECTION 40-55 OF THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA, 1973, JANUARY 8, 1985, SAID PROJECT BEING AN EIGHT UNIT RESIDENTIAL STRUCTURE ENTITLED "GLASGOW COMMONS" AND DESIGNATED AS GHP-84-20. WHEREAS, John S. Joannou has made application pursuant to ~40-55 of the Code of the City of Portsmouth, Virginia, 1973, for the granting and approval of a revision to Group Housing Project GHP-84-20; and WHEREAS, the proposed revision provides for a change in ownership form from condominium to fee simple ~ownhouse; and WHEREAS, the Council of the City of Portsmouth, Virginia, by a resolution adopted January 8, 1985 granted approval for an eight (8) unit condominium to be constructed on a parcel of land consisting of 20,767 square feet at the intersection of Green Street and Glasgow Street and more specifically described in plans made a part of the resolution approving Group Housing Project GHP-84-20 and ~he applicant has completed the construction of said residential project in accordance with said plans and now requests a change in ownership form; and WHEREAS, the developer is aware that approval of the revision requested will merely authorize the developer to file the necessary applications for subdivision approval in accordance with Chapter 33 of the Code of the City of Portsmouth, Virginia, 1973, as amended, and that this revision and change in the form of ownership would not constitute a waiver of any other requirement embodied in the Subdivision Ordinance, Zoning Ordinance or Code of the City of Portsmouth, Vi~ginia'or any'other applicable local, state or federal law or regulation. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia that the certain group housing project consisting of eight (8) residential units to be known as Glasgow Common Townhomes is hereby revised to permit a change in ownership from condominiums to fee simple townhouses subject to the following terms and conditions: 1. Developer shall obtain approval of his subdivision plat in accordance with the requirements of Chapter 33 of the Code of the City of Portsmouth, Virginia and any other applicable local, state or federal law or regulation. 2. The integrity of the building's exterior and grounds will be preserved by the establishment of a Home Owner's Association and a "Restriction Committee" whose task shall be to ensure compliance with the design approved by the Downtown D-1 Committee and City Council, and the
