73 <br /> <br />A RESOLUTION APPROVING A REVISION TO A GROUP HOUSING PROJECT <br />APPROVED PURSUANT TO SECTION 40-55 OF THE CODE OF THE CITY <br />OF PORTSMOUTH, VIRGINIA, 1973, JANUARY 8, 1985, SAID PROJECT <br />BEING AN EIGHT UNIT RESIDENTIAL STRUCTURE ENTITLED "GLASGOW <br />COMMONS" AND DESIGNATED AS GHP-84-20. <br /> <br /> WHEREAS, John S. Joannou has made application pursuant <br />to ~40-55 of the Code of the City of Portsmouth, Virginia, <br />1973, for the granting and approval of a revision to Group <br />Housing Project GHP-84-20; and <br /> <br /> WHEREAS, the proposed revision provides for a change in <br />ownership form from condominium to fee simple ~ownhouse; and <br /> <br /> WHEREAS, the Council of the City of Portsmouth, <br />Virginia, by a resolution adopted January 8, 1985 granted <br />approval for an eight (8) unit condominium to be constructed <br />on a parcel of land consisting of 20,767 square feet at the <br />intersection of Green Street and Glasgow Street and more <br />specifically described in plans made a part of the <br />resolution approving Group Housing Project GHP-84-20 and ~he <br />applicant has completed the construction of said residential <br />project in accordance with said plans and now requests a <br />change in ownership form; and <br /> <br /> WHEREAS, the developer is aware that approval of the <br />revision requested will merely authorize the developer to <br />file the necessary applications for subdivision approval in <br />accordance with Chapter 33 of the Code of the City of <br />Portsmouth, Virginia, 1973, as amended, and that this <br />revision and change in the form of ownership would not <br />constitute a waiver of any other requirement embodied in the <br />Subdivision Ordinance, Zoning Ordinance or Code of the City <br />of Portsmouth, Vi~ginia'or any'other applicable local, state <br />or federal law or regulation. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the <br />City of Portsmouth, Virginia that the certain group housing <br />project consisting of eight (8) residential units to be <br />known as Glasgow Common Townhomes is hereby revised to <br />permit a change in ownership from condominiums to fee simple <br />townhouses subject to the following terms and conditions: <br /> <br /> 1. Developer shall obtain approval of his subdivision <br />plat in accordance with the requirements of Chapter 33 of <br />the Code of the City of Portsmouth, Virginia and any other <br />applicable local, state or federal law or regulation. <br /> <br /> 2. The integrity of the building's exterior and <br />grounds will be preserved by the establishment of a Home <br />Owner's Association and a "Restriction Committee" whose task <br />shall be to ensure compliance with the design approved by <br />the Downtown D-1 Committee and City Council, and the <br /> <br /> <br />
