AN ORDINANCE TO AMEND CHAPTER 21 OF THE CODE OF THE CITY OF <br />PORTSMOUTH, VIRGINIA, 1973, AS AMENDED, BY AMENDING SECTION <br />21-24 THEREOF PERTAINING TO DRIVERS LICENSES. ~ <br /> <br /> BE IT ORDAINED by the Council of the City of <br />Portsmouth, Virginia: <br /> <br /> 1. That Section 21-24 of Chapter 21 of the Code of <br />the City of Portsmouth, Virginia, 1973, be amended to read <br />as follows: <br /> <br />Sec. 21-24. Forfeiture of driver's license; suspension of <br /> sentence. <br /> <br /> (1) Except as provided in section 18.2-271.1 of the <br />Code of Virginia, 1950, as amended, the judgment of <br />conviction if for a first offense under section 21-19, <br />shall of itself operate to deprive the person so convicted <br />of the privilege to drive or operate any motor vehicle, <br />engine or train in the Commonwealth for a period of six (6) <br />months from the date of such judgment. <br /> <br /> (2) If a person is tried on a process alleging a <br />second offense of violating section 21-19 within ten (10) <br />years of a first offense for which the person was convicted <br />under section 21-19 and is convicted thereof, such person's <br />license to operate a motor vehicle, engine or train shall <br />be revoked for a period of three (3) yea~s from the date of <br />the judgment of conviction. Any such period of license <br />suspension or revocation, in any case, shall run <br />consecutively with any period of suspension for failure to <br />permit a blood or breath sample to be taken as required by <br />section 21-21. If any person has heretofore been convicted <br />or found not innocent in the case of a juvenile of <br />violating any similar act in the Commonwealth or any other <br />state and thereafter is charged with a second violation of <br />section 21-19 and convicted of violating the provisions of <br />section 21-19, such conviction or finding shall for the <br />purpose of this section and section 21-23, be a subsequent <br />offense and shall be punished accordingly. <br /> <br /> (3) Six (6) months of any license suspension or <br />revocation imposed pursuant to this section for a first <br />offense conviction may be suspended, in whole or in part, <br />by the court upon the entry of the person convicted into <br />and the successful completion of a program pursuant to <br />section 18.2-271.1 of the Code of Virginia, 1950, as <br /> <br /> <br />
