AN ORDINANCE TO AMEND SECTION 25-34 AND <br />THE CITY OF PORTSMOUTH, VIRGINIA, 1973, <br />CHARITABLE SOLICITATIONS. <br /> <br />25-39 OF THE CODE OF <br />PERTAINING TO <br /> <br /> BE IT ORDAINED by the Council of the City of Portsmouth, <br />Virginia, that: <br /> <br /> 1. Section 25-34 of the Code of the City of Portsmouth, <br />Virginia, 1973, be amended to read as follows: <br /> <br />Section 25-34. Publication of warning concerning solicitation <br /> by professional solicitors. <br /> <br /> If the Manager determines that any charitable or civic <br />organization has contracted with a professional solicitor to <br />solicit on its behalf and that the professional solicitor may <br />be soliciting or has solicited in This City of Portsmouth, <br />directly or indirectly, by means including, without <br />limitation, by telephone or telegraph, by direct mail or by <br />advertising in national media, and , the professional <br />solicitor has not registered with the Commissioner of the <br />State Office of Consumer Affairs as required by Section 57-61 <br />of the Code of Virginia, the City Manager may, after five days <br />written notice mailed to the charitable or civic organization, <br />caused to be printed in one or more newspapers published <br />and/or distributed in the City of Portsmouth a notice on <br />substantially the following form: <br /> <br />WARNING- UNREGISTERED CHARITABLE SOLICITATION <br />BY PROFESSIONAL SOLICITOR <br /> <br /> The charitable or civic organization named <br />below has contracted with a professional <br />solicitor to solicit on its behalf. The <br />professional solicitor has not registered with <br />the Commissioner of the State office of <br />Consumer Affairs as required by law. <br />Contributors are cautioned that their <br />contributions may be used for noncharitable <br />purposes. <br /> <br /> Every professional solicitor who solicits contributions <br />from a prospective contributor in the City of Portsmouth: (i) <br />shall identify himself and his employer; (ii) shall further <br />disclose that he is a paid solicitor; and (iii) shall further <br />disclose, in writing, the fact that a financial statement for <br />the last fiscal year ~s available from the State Office of <br />Consumer Affairs. <br /> <br /> <br />
