AN ORDINANCE TO AMEND THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA, 1973, BY AMENDING SECTIONS 40-223, 40-55 (5) AND SECTION 33-69 THEREOF, PERTAINING TO FEES FOR REZONING, GROUP HOUSING AND SUBDIVISIONS. BE IT ORDAINED by the Council of the City of Portsmouth, Virginia: 1. That Section 40-223 of the Code of the City of Portsmouth, Virginia, 1973, be amended to read as follows: Section 40-223. Fee to cover cost of advertising and processing proposed change. The Planning Director shall not accept for filing, nor shall the Planning Commission or City Council consider any petition proposing an amendment to this Chapter or the Zoning Map unless and until the person or persons requesting the amendment shall have filed with the Planning Director a receipt showing the payment to the City Treasurer of the sum of one hundred dollars ($100%00) to cover the cost of advertising and processing the proposed amendment. Upon the filing of the petition and the aforesaid receipt, =he Planning Director shall endorse upon the petition the following: "deposit made as required by law". 2. That Section 40-55 (5) of the Code of the City of Portsmouth, Virginia, 1973, be amended to read as follows: Section 40-55. Group housing project review. (5) A fee of ten dollars shall be charged for processing applications. (S10.00) per dwelling unit group housing project 3. That Section 33-69 (a) of the Code of the City of Portsmouth, Virginia, 1973, be amended to read as follows: Section 33-69. Fees and penalties. (a) There shall be a charge for the examination and review of every subdivision plat submitted. This fee shall be in the amount of ten dollars ($10.00) for each dwelling unit and/or lot and one hundred dollars ($100) per acre for commercially or industrial developed land in a subdivision with a minimum of fifty dollars ($50.00) for any plat. The fee shall be paid at the time of application for final plat approval.
