AN ORDINANCE TO AMEND SECTION 31-201 OF THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA, 1973, BY AMENDING THE DEFINITION OF "EMPLOYEE" PERTAINING TO THE PORTSMOUTH SUPPLEMENTAL RETIREMENT SYSTEM. BE IT ORDAINED by the Council of the City of Portsmouth, Virginia, that the definition of the term "employee" as set forth in Section 31-201 of the Code of the City of Portsmouth, Virginia, 1973, be amended to read as follows: Employee. The word "employee" shall be taken to mean any person regularly employed in the service of the City on a full-time permanent basis and whose compensation is wholly paid by the City, and persons holding offices in the City required by the Constitution of the State and their deputies, assistants and employees employed on a full-time permanent basis and whose compensation is paid partly by the City and partly by the State, and members of the Portsmouth City Council; but shall not include any person who is eligible for membership in the Virginia Supplemental Retirement System, the Portsmouth Fire and Police Retirement System or who enters into an agreement with the City for inclusion in a deferred compensation retirement plan which agreement specifically prohibits inclusion in other retirement systems established by the Cfty. An employee shall also be taken to mean any person employed under a grant program who has been regularly employed in the service of the City on a full-time basis for a period such that he will have become vested under the conditions as stated in Section 31-262, and whereby such grant program has participated in making the necessary contributions to the system for the ~full period of the employee's service to be credited. In case of doubt, the Board shall decide who is an employee within the meaning of this article. Adopted by the Council of the City of Portsmouth, Virginia, at a meeting held June 9, 1987.
