AN ORDINANCE TO AMEND SECTION 31-201 OF THE CODE OF THE CITY <br />OF PORTSMOUTH, VIRGINIA, 1973, BY AMENDING THE DEFINITION OF <br />"EMPLOYEE" PERTAINING TO THE PORTSMOUTH SUPPLEMENTAL <br />RETIREMENT SYSTEM. <br /> <br /> BE IT ORDAINED by the Council of the City of Portsmouth, <br />Virginia, that the definition of the term "employee" as set <br />forth in Section 31-201 of the Code of the City of <br />Portsmouth, Virginia, 1973, be amended to read as follows: <br /> <br />Employee. <br /> <br /> The word "employee" shall be taken to mean any person <br />regularly employed in the service of the City on a full-time <br />permanent basis and whose compensation is wholly paid by the <br />City, and persons holding offices in the City required by the <br />Constitution of the State and their deputies, assistants and <br />employees employed on a full-time permanent basis and whose <br />compensation is paid partly by the City and partly by the <br />State, and members of the Portsmouth City Council; but shall <br />not include any person who is eligible for membership in the <br />Virginia Supplemental Retirement System, the Portsmouth Fire <br />and Police Retirement System or who enters into an agreement <br />with the City for inclusion in a deferred compensation <br />retirement plan which agreement specifically prohibits <br />inclusion in other retirement systems established by the <br />Cfty. An employee shall also be taken to mean any person <br />employed under a grant program who has been regularly <br />employed in the service of the City on a full-time basis for <br />a period such that he will have become vested under the <br />conditions as stated in Section 31-262, and whereby such <br />grant program has participated in making the necessary <br />contributions to the system for the ~full period of the <br />employee's service to be credited. In case of doubt, the <br />Board shall decide who is an employee within the meaning of <br />this article. <br /> <br /> Adopted by the Council of the City of Portsmouth, <br />Virginia, at a meeting held June 9, 1987. <br /> <br />Teste: <br /> <br />City Clerk <br /> <br /> <br />
