-AN ORDINANCE TO AMEND THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA, 1973, BY AMENDING SECTION 40-138 BY ADDING THERETO SUBPARAGRAPH (p) PERTAINING TO RESIDENTIAL DIMENSIONAL REQUIREMENTS IN R-60 AND R-60-A ZONING DISTRICTS. BE IT ORDAINED by the Council of the City of Portsmouth, Virginia: 1. That Virginia, 1973, subsection (p), the Code of the City of Portsmouth, be amended by adding to ~40-138 such new subsection to read as follows: Section 40-138. Residential R-60 and Residential R-60-A District Dimensional Requirements. Within the Residential R-60 and Residential R-60-A Districts as shown on the Zoning Map, all the following dimensional requirements shall be complied with: (p) Reduction of minimum required floor area for housing for the elderly: The minimum required floor area for dwelling unit exclusive of garages and patios for milti-family dwellings may be reduced to four hundred seventy-five (475) square feet for a one (1) bedroom unit and six hundred (600) square feet for a two (2) bedroom unit when such housing is designed exclusively as housing for the elderly as defined in this Code when permitted by resolution of the Planning Commission. No such reduction shall be authorized except upon assurances satisfactory to the Planning Commission that such housing is designed exclusively as~housing for the elderly as defined in this Code. After such reduction has been authorized the premises shall not be used other than for housing for the elderly unless and until compliance with the minimum required floor area applicable to the new use has been made. 2. This ordinance shall take effect from the date of its adoption. Adopted by the Council of the City of Portsmouth, Virginia at a meeting held January 27, 1987. Teste: City Clerk
