-AN ORDINANCE TO AMEND THE CODE OF THE CITY OF <br />PORTSMOUTH, VIRGINIA, 1973, BY AMENDING SECTION 40-138 <br />BY ADDING THERETO SUBPARAGRAPH (p) PERTAINING TO <br />RESIDENTIAL DIMENSIONAL REQUIREMENTS IN R-60 AND R-60-A <br />ZONING DISTRICTS. <br /> <br /> BE IT ORDAINED by the Council of the City of <br />Portsmouth, Virginia: <br /> <br /> 1. That <br />Virginia, 1973, <br />subsection (p), <br /> <br />the Code of the City of Portsmouth, <br /> be amended by adding to ~40-138 <br /> such new subsection to read as follows: <br /> <br />Section 40-138. Residential R-60 and Residential R-60-A <br /> District Dimensional Requirements. <br /> <br /> Within the Residential R-60 and Residential R-60-A <br />Districts as shown on the Zoning Map, all the following <br />dimensional requirements shall be complied with: <br /> <br /> (p) Reduction of minimum required floor area for <br />housing for the elderly: <br /> <br /> The minimum required floor area for dwelling unit <br />exclusive of garages and patios for milti-family <br />dwellings may be reduced to four hundred seventy-five <br />(475) square feet for a one (1) bedroom unit and six <br />hundred (600) square feet for a two (2) bedroom unit <br />when such housing is designed exclusively as housing for <br />the elderly as defined in this Code when permitted by <br />resolution of the Planning Commission. No such <br />reduction shall be authorized except upon assurances <br />satisfactory to the Planning Commission that such <br />housing is designed exclusively as~housing for the <br />elderly as defined in this Code. After such reduction <br />has been authorized the premises shall not be used other <br />than for housing for the elderly unless and until <br />compliance with the minimum required floor area <br />applicable to the new use has been made. <br /> <br /> 2. This ordinance shall take effect from the date <br />of its adoption. <br /> <br /> Adopted by the Council of the City of Portsmouth, <br />Virginia at a meeting held January 27, 1987. <br /> <br />Teste: <br /> <br />City Clerk <br /> <br /> <br />
