AN ORDINANCE TO AMEND THE CODE OF THE CITY OF PORTSMOUTH, <br />VIRGINIA, 19J3, BY AMENDING SECTIONS 21-19, 21-2], 21-38, <br />21-40, 21-83, 21-115, 21-125, AND 21-148 (b) AND BY <br />ENACTING SECTION 21-141.1 OF CHAPTER 21 THEREOF, PERTAINING <br />TO MISCELLANEOUS OFFENSES. <br /> <br /> BE IT ORDAINED by the Council of the City of <br />Portsmouth: <br /> <br /> 1. That Sections 21-19, 21-21, 21-38, 21-40, 21-115, <br />21-125 and 21-148(b) of the Code of the City of Portsmouth, <br />Virginia, 1973, be amended to read as follows: <br /> <br />Section 21-19. Driving motor vehicle, engines, etc., while <br /> intoxicated. <br /> <br /> It shall be unlawful for any person to drive or <br />operate any motor vehicle, engine or train Ii) while such <br />person has a blood alcohol concentration of 0.10 per cent <br />or more by weight by volume as indicated by a chemical test <br />administered in accordance with the provisions of section <br />21-21; (ii) while such person is under the influence of <br />alcohol; or (iii) while such person is under the influence <br />of any narcotic drug or any other self-administered <br />intoxicant or drug of whatsoever nature, or any combination <br />of such drugs, to a degree which impairs his ability to <br />drive safely, or (iv) while such person is under the <br />combined influence of alcchol and any drug or drugs to a <br />degree which impairs his ability to drive safely. For the <br />purposes of this section, the term "motor vehicle" shall <br />include mopeds, while operated on the roads and streets of <br />the city and the public highways of the Commonwealth within <br />the city. <br /> <br />Section 21-21. <br /> <br />Use of chemical test to determine alcohol <br />in blood; procedure, qualifications and <br />liability of person withdrawing blood; <br />costs; evidence; suspension of~license for <br />refusal to submit to test. <br /> <br /> The provisions of Section 18.2-268(a) through (s) of <br />Article II of Chapter 7 of Title 18.2 of the Code of <br />Virginia of 1950, aK amended, in effect on July 1, 1987, <br />are hereby incorporated by reference and adopted as a part <br />of this Code. <br /> <br /> <br />
