AN ORDINANCE TO AMEND THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA, 19J3, BY AMENDING SECTIONS 21-19, 21-2], 21-38, 21-40, 21-83, 21-115, 21-125, AND 21-148 (b) AND BY ENACTING SECTION 21-141.1 OF CHAPTER 21 THEREOF, PERTAINING TO MISCELLANEOUS OFFENSES. BE IT ORDAINED by the Council of the City of Portsmouth: 1. That Sections 21-19, 21-21, 21-38, 21-40, 21-115, 21-125 and 21-148(b) of the Code of the City of Portsmouth, Virginia, 1973, be amended to read as follows: Section 21-19. Driving motor vehicle, engines, etc., while intoxicated. It shall be unlawful for any person to drive or operate any motor vehicle, engine or train Ii) while such person has a blood alcohol concentration of 0.10 per cent or more by weight by volume as indicated by a chemical test administered in accordance with the provisions of section 21-21; (ii) while such person is under the influence of alcohol; or (iii) while such person is under the influence of any narcotic drug or any other self-administered intoxicant or drug of whatsoever nature, or any combination of such drugs, to a degree which impairs his ability to drive safely, or (iv) while such person is under the combined influence of alcchol and any drug or drugs to a degree which impairs his ability to drive safely. For the purposes of this section, the term "motor vehicle" shall include mopeds, while operated on the roads and streets of the city and the public highways of the Commonwealth within the city. Section 21-21. Use of chemical test to determine alcohol in blood; procedure, qualifications and liability of person withdrawing blood; costs; evidence; suspension of~license for refusal to submit to test. The provisions of Section 18.2-268(a) through (s) of Article II of Chapter 7 of Title 18.2 of the Code of Virginia of 1950, aK amended, in effect on July 1, 1987, are hereby incorporated by reference and adopted as a part of this Code.
