31 <br /> <br />A RESOLUTION GRANTING A USE PERMIT TO ALLIANCE LIFE CARE <br />CORPORATION TO OPERATE A ONE HUNDRED EIGHTY BED NURSING HO~ <br />IN THE CAVALIER MANOR NEIGHBORHOOD. <br /> <br /> ~ WHEREAS, Steven Gold, Vice-President of Operations for <br />Alliance Life Care Corporation, has made application pursuant <br />to §40-75 (b) of the Code of the City of Portsmouth, <br />Virginia, as amended, for the granting of a use permit as <br />hereinafter-described; and <br /> <br /> WHEREAS, the applicant and the Planning Director have <br />done all things required to be done in connection with said <br />application; and <br /> <br /> WHEREAS, the Planning Commission has recommended the <br />granting of said use permit with conditions. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the <br />City of Portsmouth, Virginia: <br /> <br />1. That the use for which the use permit is sought: <br /> <br /> (a) Will non affect the health and safety of <br />persons residing or working in the neighborhood of the <br />proposed use; <br /> <br /> (b) Will non be detrimental no the public <br />injurious no the property or improvements in the <br />neighborhood; and <br /> <br />use or <br /> <br /> (c) Will be in accord with.the purposes of the <br />Zoning Chapter of the City Code. <br /> <br /> 2. Alliance Life Care Corporation is hereby granted a <br />use permit pursuant to §40-75 (b) of the Code of the City of <br />Portsmouth, Virginia to operate a one hundred eighty (180) <br />bed nursing home, such facility to be located on property <br />lying on the west side of Cavalier Boulevard south of <br />Greenwood Drive (Tax Map 548, a portion of Parcel 1), such <br />parcel consisting of 5.45 acres and the facility constructed <br />thereon to encompass, but not be limited, to a beauty shop, <br />activity rooms and television rooms to fulfill the personal <br />and recreational needs of the residents of the proposed <br />structure. <br /> <br /> 3. This use permit is approved subject to the following <br />conditions: <br /> <br /> <br />
