30 <br /> <br />A RESOLUTION GRANTING APPROVAL FOR A GROUP HOUSING PROJECT <br />PURSUANT TO SECTION~0-55 OF T~E CODE OF THE CITY OF <br />PORTSMOUTH, VIRGINIA, 1973, SAID PROJECT CONSISTING OF ONE <br />HUNDRED NINETY SIX (196) RENTAL APARTMENT UNITS ON 15.08 <br />ACRES OF LAND ON THE EAST SIDE OF TWIN PIN'ES ROAD. <br /> <br /> WHEREAS, Associated Churchland Investors, by Ronald <br />Ripley of 3 R&W, Inc., has made aDplication pursuant to <br />§40-55 of the Code of th? City of PortsmoUth, Virginia, 1973, <br />as amended for the granting and approval of a group housing <br />project consisting of one hundred ninety six (196) rental <br />apartment units on a 15.08 acre parcel on the east side of <br />Twin Pines Road and further described as Tax Map 846, Parcel <br />3 and Tax Map 900, Parcel 1 such group housing project having <br />been designated as GHP-87-3; and <br /> <br /> WHEREAS, the application has been determined by the <br />Planning Commission to have met the requirements of §40-55 of <br />the Code of the City of Portsmouth, Virginia, 1973, as <br />amended and the Planning Commission has reviewed such <br />application and site plans submitted therewith and has <br />recommended a conditional approval of said application; and <br /> <br /> WHEREAS, the Council of the City of Portsmouth has <br />reviewed the prQposed group housing project and revisions <br />thereto and site plans submitted with such revisions; and <br /> <br /> WHEREAS, the developer has been informed that the <br />approval of a group housing project pursuant to ~40-55 grants <br />only an exemption from certain requirements for residences as <br />stated in said section and does not constitute a waiver of <br />any other requirement embodied in the Subdivision Ordinance, <br />Zoning Ordinance, Code of the City of Portsmouth, Virginia, <br />or any other applicable local, State or Federal law or <br />regulation; and <br /> <br /> WHEREAs, the developer is aware that building permits or <br />any other required permit will be issued only upon compliance <br />with the ordinances, laws and regulations applicable thereto. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the <br /> City of Portsmouth, Virginia that the certain group housing <br /> project specifically designated as GHP-87-3 as revised and <br />-more specifically designated on plans filed with the <br /> appropriate officials of the City of Portsmouth, Virginia, <br /> such plans and documentations in support thereof being made a <br /> part hereof is hereby granted apprQval subject to the <br /> following terms and conditions: <br /> <br /> <br />
