t6 A RESOLUTION AUTHORIZING THE CITY MANAGER TO ENTER INTO AGREEMENTS WITH SWEETBRIAR DEVELOPMENT CORPORATION AND CSX TRANSPORTATION, INC., FOR INSTALLATION OF A WATER LINE AND SANITARY SEWER LINE. WHEREAS, Sweetbriar Development Corporation desires to develop certain property in the vicinity of Seaguard Avenue and Bedford Court as a commercial and industrial development area to be known as Greenwood Industrial Park; and WHEREAS, said sanitary sewer and property; and development requires the extension of water utility services to the subject WHEREAS, the extension of said utility services will be under and across the railroad lines of CSX Transportation, Inc.; and WHEREAS, the cost of installation of said utility lines shall be paid by the developer~ after which said utility lines shall be dedicated to and maintained by the City of Portsmouth; and WHEREAS, said utility lines shall be installed pursuant to the construction requirements of CSX Transportation, Inc.; and WHEREAS, pursuant to said terms, CSX Transportation, Inc., has agreed to issue a license and right-of-way for the purpose of installing and maintaining said utility service lines. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia, that the City Manager be, and he hereby is, authorized to enter into agreements with Sweetbriar Development Corporation and CSX Transportation, Inc., for the purpose of installing, operatin~ and maintaining an eight inch potable water line and a sanitary sewer main over, under and across the property of CSX Transportation, Inc., at a point 2,756.73-2,766.73 feet southeastwardly measured along the center line of CSX main track from milepost SA-6.
