A RESOLUTION AMENDING THE APPROVAL GRANTED FOR A'GROUP <br />HOUSING PROJECT PURSUANT TO SECTION 40-55 OF THE CODE OF <br />THE CITY OF PORTSMOUTH, VIRGINIA, 1973, SAID PROJECT <br />BEING KNOWN AS "PEPPERWOOD III" AND DESIGNATED AS <br />GHP-85-8. <br /> <br /> WHEREAS, the Council of the City of Portsmouth, <br />Virginia adopted at a meeting held May 28, 1985 a <br />resolution granting approval for a group housing project <br />pursuant to ~40-55 of the Code of the City of <br />Portsmouth, Virginia, 1973, said project being known as <br />"Pepperwood III" and designated as GHP-85-8 and <br />consisting of ninety-seven (97) townhouse-style <br />apartments on 6.96 acres located between Pepperwood <br />Court and the proposed Western Freeway; and <br /> <br /> WHEREAS, Benjamin J. Levy, attorney for James B. <br />Bickford, has made application pursuant to §40-55 of the <br />Code of the City of Portsmouth, Virginia, 1973, for a <br />revision to the conditions attached to said group <br />housing project approval; and <br /> <br /> WHEREAS, the condition in question pertains to <br />access to the subject project and its deletion is being <br />requested as a result of the construction of the Western <br />Freeway; and <br /> <br /> WHEREAS, the Planning Commission <br />application for revision and has made <br />thereon; and <br /> <br />has reviewed such <br />a recommendation <br /> <br /> WHEREAS, the developer is aware that approval of <br />the revision requested would not constitute a waiver of <br />any other requirement embodied in the Subdivision <br />Ordinance, Zoning Ordinance, or Code of the City of <br />Portsmouth, Virginia or any other applicable local, <br />state, or federal law or regulation, and that all the <br />remaining terms and conditions of the group housing <br />project approval would remain in full force and effect. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of <br />the City of Portsmouth, Virginia that the resolution <br />approved by the Council of the City of Portsmouth, <br />Virginia on May 28, 1985 granting approval for group <br />housing project-(GHP-85-8) known as "Pepperwood III" is <br />hereby revised to delete condition (4) as provided in <br />said resolution; and <br /> <br /> <br />
