A RESOLUTION GRANTING A USE PERMIT TO THE JAMES CHISHOLM FOUNDATION TO OPERATE A TEMPORARY RESIDENCE FACILITY AT 313 GREEN STREET IN THE ASHLEY SQUARE CONDOMINIUM PROJECT. 119 WHEREAS, Mary Johnson, President of the James Chisholm Foundation, has made application pursuant to §40-121 (a) (i) of the Code of the City of Portsmouth, Virginia, as amended, for the granting of a use permit as hereinafter-described; and WHEREAS, the applicant and the done all things required to be done application; and Planning Director have in connection with said WHEREAS, the Planning Commission has recommended the granting of said use permit, with conditions. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: 1. That the use for which the use permit is sought: (a) will not affect persons residing or working in proposed use; the health and safety of the neighborhood of the (b) Will not be detrimental to the public use or injurious to the property or improvements in the neighborhood; and (c) Will be in accordance with the purposes of the Zoning Chapter of the City Code. 2. The James Chisholm Foundation is hereby granted a use permit pursuant to ~40-121 ~a) (i) of the Code of the City of Portsmouth, Virginia, to operate a temporary residence facility for sixteen (16) residents at 313 Green Street in the Ashley Square Condominium Project units 18, 19, 20, 21, 22, and 23 (UP-87-25). 3. This use permit is approved subject to the following conditions: (a) No more than sixteen (16) residents can be accommodated within the facility at any one time. (b) All signage and exterior changes for the building must be approved by the Downtown Design Committee. (c) Any changes to the interior must be submitted to the Planning Department staff for review and approval.
