110 A RESOLUTION GRANTING A USE PERMIT TO LAPETITE ACADEMY, INC. TO OPERATE A CHILD CARE CENTER AT 3907 CEDAR LANE. WHEREAS, Richard K. Stell, on behalf of LaPetite Academy, Inc., has made application pursuant to ~40-75 (b) of the Code of the City of Portsmouth, Virginia, 1973, for the granting of a use permit to operate a child care center at 3907 Cedar Lane; and WHEREAS, the applicant and the done all things required to be done application; 'and Planning Director have in connection with said WHEREAS, the Planning commission has recommended the conditional granting of a use permit for the operation of child care center. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: 1. That the use for which the use permit is sought: (a) Will not adversely affect the health and safety of persons residing or working in the neighborhood of the proposed use; (b) injurious to and Will not be detrimental to the public use or the property or improvements of the neighborhood; (c) Will be in accordance with the purposes of the Zoning Chapter of the City Code. 2. LaPetite Academy, Inc. is hereby granted a use permit pursuant to ~40-75 (b) of the Code of the City of Portsmouth, Virginia, 1973, to operate a child care center at 3907 Cedar Lane (Tax Map 721, Parcel 3.1), the activities to be conducted within a facility to be constructed encompassing 5,465 square feet of building on a 31,798 square foot lot (UP-87-23). 3. This use permit is approved subject to the following conditions-. (a) The facility may be operated with an enrollment of not more than one hundred fifteen (115) children to be cared for at the facility at any one time. (b) A five foot (5') wood privacy fence shall be installed enclosing a minimum play area of 10,300 square feet. (c) A five foot (5') wood privacy fence shall be installed around the dumpster area.
