~ RESOLUTION GRANTING A USE PERMIT TO LOUIS C. .OPERATE A JUNKYARD AT 800 PENINSULA AVENUE. BELL, III TO 103 WHEREAS, Kennith W. Tomosovich, owner, by Louis C. Bell, III has made application pursuant to ~40-69 (b) of the Code of the City of Portsmouth, Virginia, as amended, for the granting of a us~ permit as hereinafter-described; and WHEREAS, the applicant and the done all things required to be done application; and Planning Director have in connection with said WHEREAS, the Planning Commission has recommended the granting of said use permit, with conditions. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: 1. That the use for which the use permit is sought: (a) Will not affect the health and safety of persons residing or working in the neighborhood of the proposed use; (b) injurious to neighborhood; Will not be detrimental to the public use or the property and improvements in the ~ and (c) Will be in accord with the purposes of the Zoning Chapter of the City Code. 2. Louis C. Bell, III is hereby, granted a use permit pursuant to ~40-69 (b) of the Code of the City of Portsmouth, Virginia, to operate a junkyard as that term is defined therein at ~800 PeninsUla Avenue, Csuch parcel being more particularly described as Tax Map 188, Parcel 1 (UP-87-20). 3. This use permit is approved subject to the following condifiions: (a) This use permit shall expire on November 1, 1988, and any request for an extension of time must be supported by findings such as would be required if the Use permit was being requested for the first time. - (b) The operator of the junkyard must meet all applicable code requirements for junkyards including, but limited to, the eight foot (8') fence or wall requirement provided for in S40-69 (b). not
