100 <br /> <br />A RESOLUTION GRANTING APPROVAL FOR A GROUP HOUSING PROJECT <br />PURSUANT TO SECTION 40-55 OF THE CODE OF THE CITY OF <br />PORTSMOUTH, VIRGINIA, 1973, AS AMENDED, SAID PROJECT BEING <br />LOCATED ON 18 ACRES OF WATERFRONT PROPERTY ON THE SOUTHERN <br />PORTION OF THE FORMER BEASLEY FARM SITE AND CONSISTING OF 147 <br />LOW-RISE AND 41 TOWN HOUSE CONDOMINIUMS SAID PROJECT BEING <br />KNOWN AS CAMBRIA CALL AT RIVER POINTE AND DESIGNATED AS <br />GHP-87-13. <br /> <br /> WHEREAS, Garcia-Gelardi Development Corporation by Earl <br />J. Newman, President of Newman Construction Corporation has <br />made application pursuant to Section 40-55 of the Code of the <br />City of Portsmouth, Virginia, 1973, as amended, for the <br />granting and approval of a Group Housing Project consisting of <br />147 low-rise and 41 town house condominiums on 18 acres of <br />waterfront property on the southern portion of the former <br />Beasley Farm and designated as GHP-85-15 such parcel being <br />more particularly described as ~arcel 2 in Zoning Amendment <br />Ordinance Z-87-19; and <br /> <br /> WHEREAS, the application has been determined by the <br />Planning Commission to have met the requirements of Section <br />40-55 of the Code of the City of Portsmouth, Virginia, 1973, <br />as amended; and <br /> <br /> WHEREAS, the Planning Commission has reviewed such <br />application and site plans submitted therewith and has <br />recommended conditional approval of said application; and <br /> <br /> WHEREAS, the developer has been informed that approval of <br />a Group Housing Project pursuaht to the Section 40-55 grants <br />only an exemption from certain requirements for residences as <br />stated in said section and does not constitute a waiver of any <br />other requirement embodied in the Subdivision Ordinance, <br />Zoning Ordinance, Code of the City of Portsmouth, Virginia, or <br />any other applicable local, State or Federal law or <br />regulation; and <br /> <br /> WHEREAS, the developer is aware that building permits or <br />any other required permit will be issued only upon compliance <br />with the ordinances, laws or regulations applicable thereto. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City <br />of Portsmouth, Virginia, that the certain Group Housing <br />Project designated as GHP-87-13 entitled "Cambria Call at <br />River Pointe" and being more specifically described in <br />correspondence from Newman Construction Corporation dated <br />August 14, 1987 as shown on plans entitled "River Pointe" <br />filed with the appropriate officials of the City of <br />Portsmouth, Virginia, such being made a part hereof, is hereby <br /> <br /> <br />
