97¸ <br /> <br />A RESOLUTION AUTHORIZING THE CITY MANAGER TO RELEASE A <br />PUBLIC UTILITY EASEMENT AT THE INTERSECTION OF DEEP <br />CREEK BOULEVARD AND KIRBY STREET. <br /> <br /> WHEREAS, by Deed dated August 31, 1979, recorded in <br />the Deed Book 765, Page 570 in the Clerk's office of <br />the Circuit Court of the City of Portsmouth, Virginia, a <br />Public utility Sewer Easement was dedicated on the <br />hereinafter described property; and <br /> <br /> WHEREAS, said easement is no longer required for <br />public purposes; and <br /> <br /> WHEREAS, the present owners of the subject property <br />have requested that the easement be released. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of <br />the City of Portsmouth, Virginia, that the City Manager <br />be, and hereby is, authorized to execute a deed of <br />release for a public utility sewer easement at the <br />intersection of Deep Creek Boulevard and Kirby Street, <br />more particularly described as follows, to-wit: <br /> <br /> Ail those certain portions of lots 1, 2 <br />3, 4, and 5 in Block C on the plat of <br />South Highlands, No. 2, recorded in the Clerk's <br />Office of the Circuit Court of the City of <br />Chesapeake, Virginia, in Map Book 17, Page 76, <br />and designated on the pla~ attached hereto <br />entitled "Plat showing sewer easement located <br />oR portion of lots 1 thru 5 Block C South <br />Highlands No. 2" dated August 9, 1979. <br /> <br /> Adopted by the Council of the City of Portsmouth, <br />Virginia, at a meeting held October 13, 1987. <br /> <br />Teste: <br /> <br />City Clerk <br /> <br /> <br />
