A RESOLUTION GRANTING A USE PE~'~IT TO PORTSMOUTH CHILDREN'S HOME, INC.- FOR THE OPERATION OF HOLIDAY HOUSE OF PORTSMOUTH, INC., A GROUP HOME FCR CHILDREN AT 4211 COUNTY STREET. WHEREAS, Portsmouth Children's Home, Inc. by William Oast, III, Attorney, has made application pursuant to ~40-75 (b) of the Code of the City of Portsmouth, Virginia, as amended, for the granting of a use permit as hereinafter-described; and WHEREAS, the applicant and the Planning Director have done all things required to be done in connection with said application; and WHEREAS, Holiday House has provided services to severely retarded children and young adults since the early 1900's and the current facility was established prior to the use permit requirements for residential care facilities within the Residential R-75 Zone; and WHEREAS, a use permit is now required in order for the facility to construct an activity and therapy cottage on the site but there will be no additional staff or residents of the facility as a result of the new structure; and WHEREAS, the Planning Commission has recommended the granting of said use permit with conditions. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: 1. That the use for which the use permit is sought: (a) Will not affect the health and safety of persons residing or working in the neighborhood of the proposed use; (b) Will not be detrimental to the public use or in3urious to the property and improvements in the neighborhood; and (c) Will be in accordance with the purposes of the Zoning Chapter of the City Code. 2. Portsmouth Children's Home, Inc. is hereby granted a use permit pursuant to ~40-75 (b) of the Code of the City of Portsmouth, Virginia, to operate Holiday House of Portsmouth, Inc., a group home for children located at 4211 County Street, such property being a 1.788 acre parcel more particularly described as Tax Map 306, Parcel 50.
