66 <br /> <br />A RESOLUTION AUTHORIZING THE CITY MANAGER TO ENTER ~NTO AN <br />EASEMENT AGREEMENT WITH HAMPTON ROADS SANITATION DISTRICT FOR <br />THE PURPOSE OF PROVIDING TEMPORARY CONSTRUCTION EASEMENTS AND <br />A PERMANENT EASEMENT FOR CONSTRUCTION OF THE VIRGINIA <br />INITIATIVE-ELIZABETH RIVER CROSSING-SANITARY SEWER FORCE MAIN <br />PROJECT. <br /> <br /> WHEREAS, the City of Portsmouth and Hampton Roads <br />Sanitation District have entered into an agreement dated March <br />26, 1986, as amended, for purchase of the Pinners Point Sewage <br />Treatment Plant and inclusion of the City of Portsmouth in <br />Hampton Roads Sanitation District; and <br /> <br /> WHEREAS, Hampton Roads Sanitation District has made <br />application to the United States Environmental Protection <br />Agency and the State Water Control Board for approval to <br />construct the virginia Initiative-Elizabeth River <br />Crossing-Sanitary Sewer Force Main Project; and <br /> <br /> WHEREAS, said construction would also <br />construction of a pipeline crossing of the <br />from Portsmouth to Norfolk; and <br /> <br />require <br />Elizabeth River <br /> <br /> WHEREAS, said pipeline would be constructed from the <br />Pinners Point Sewage Treatment Plant across City-owned <br />property leased to Portsmouth Port and Industrial Commission <br />and subleased to Sealand Corporation; and <br /> <br /> WHEREAS, Portsmouth Port and Industrial Commission and <br />Sealand Corporation have indicated concurrence in the plans <br />for construction of said pipeline. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the city <br />of Portsmouth, Virginia, that the City Manager be, and he <br />hereby is, authorized to enter into an easement agreement with <br />Hampton Roads Sanitation District for the purpose of providing <br />temporary construction easements and a permanent easement for <br />construction of the Virginia initiative-Elizabeth River <br />Crossing-Sanitary Sewer Force Main Project over, under and <br />across the following described property: <br /> <br />Temporary Easement No. 1 <br /> <br /> BeginnIng at the intersection of the <br />western line of the property of the City of <br />portsmouth, Virginia, currently leased to <br />Sealand, with the ncrthern right-of-way line <br />of Seaboard Avenue; thence along said western <br />line N 10° 12' 55" W, 41.75 feet to a point, <br />said point being the true point of beginning <br />for this description; thence N 84° 50' 20" E, <br /> <br /> <br />
