A RESOLUTION GRANTING A USE PERMIT TO HAROLD BEAVER TO OPERATE A GROUP HOME FOR ADULTS ON PROPERTY LOCATED ON THE NORTH SIDE OF AIRLINE BOULEVARD BETWEEN LANCER DRIVE AND YORKSHIRE ROAD. WHEREAS, Harold Beaver, contractor owner, has made application pursuant to ~40-71 (b) of the Code of the City of Portsmouth, Virginia, as amended, for the granting of a use permit as hereinafter-described; and WHEREAS, the applicant and the Planning Director have done all things required to be done in connection with said application; and WHEREAS, the Planning Commission has recommended the granting of said use permit, with conditions. NOW, THEREFORE, BE IT RESOLVED by the Council o~ the City of Portsmouth, Virginia: 1. That the use for which the use permit is sought: (a) Will not affect the health and safety of persons residing or working in the neighborhood of the proposed use; (b) Will not be detrimental to the public use or injurious to the property or improvements in the neighborhood; and (c) Will be in accord with the purposes of the Zoning Chapter of the City Code. 2. Harold Beaver is hereby granted a use permit pursuant to ~40-71 (b) of the Code of the City of Portsmouth, Virginia, as amended, to operate a group home for adults, such facility to consist of three (3) connecting buildings, two (2) to house residents and the third (3rd) to serve as an administrative building on a 2.71 acre parcel of property on the north side of Airline Boulevard between Lancer Drive and Yorkshire Road (Tax Map 583, Parcel 1 and a portion of Parcels 3 and 6), such property being more particularly described as follows: UP-86-15 BEGINNING at the northeast corner of Airline Boulevard and Yorkshire Road; thence northerly along the east right-of-way of Yorkshire Road 200'; thence in a northerly direction 338.9'; thence easterly 135.5'; thence east 47'; thence east 34'; thence
