14 - <br /> <br /> 11. The Assistant City Manager for Administration <br />and Finance is directed to hold the good faith check <br />submitted by the Underwriters at the time of the execution <br />of the Bond Purchase Agreement and to return such good faith <br />check to the Purchasers at the time of the delivery of and <br />payment for the Bonds or otherwise to apply such check in <br />accordance with the terms of the Bond Purchase Agreement. <br /> <br /> 12. (a) The proceeds of sale of the Bonds shall <br />be applied to the pa~en~ of the costs of the public <br />improvement projects described below in substantially the <br />amounts set forth opposite the description of the respective <br />pro3ec~s: <br /> <br />PROJECTS AMOUNT <br /> <br />Community Services $ 565,747 <br />Education 246,000 <br />Parks and Recreation 1,639,400 <br />Drainage, Curbs, Gutters and <br />Street Improvements 4,271,137 <br />Urban Renewal and Priority Action <br />Prog rams 300,000 <br />Industrial and Economic Development 112,716 <br /> <br />$7,135,000 <br /> <br />provided, that if any such project shall require less than <br />the entire respective aalount set forth above, the difference <br />may be applied to pay the cost of any other projec~ so set <br />forth. <br /> <br /> (b) The City Attorney of the City is directed to <br />file a copy of this.resolution, certified by the City Clerk <br />of the City to be a true copy hereof, with the Clerk of the <br />Circuit Court of the City of Portsmouth, Virginia, and such <br />City Clerk is directed to publish once within ten (10) days <br />of the date of filing of such resolution a notice with <br />respect thereto in The Virginian Pilot, a newspaper of <br />general circulation in the City, in accordance with Section <br />15.1-199 of the Code of Virginia, 1950, as amended. Such <br />notice shall be in substantially the following form: <br /> <br />"LEGAL NOTICE <br /> <br /> Notice is hereby given pursuant to Section <br />15.1-199 of the Code of Virginia, 1950, as amended, that the <br />Council of the City of Portsmouth, Virginia, adopted on <br />April 14, 1987, a resolution authorizing the issuance, as a <br />whole at one t~me or in part from time to time, $7,135,000 <br />aggregate principal amount of general obligation Public <br />Improvement Bonds and caused a certified copy of such <br />resolution to be filed with the Circuit Court of the City of <br />Portsmouth on April , 1987. <br /> <br /> <br />
