Nothing in this section shall be construed as affecting the <br />right of any person to seek compensation for any injury in <br />fact incurred by him because of the proposed activity. If the <br />Wetlands Board finds that the anticipated public and private <br />benefit from the proposed activity is exceeded by the <br />anticipated public and private detriment or that the proposed <br />activity would violate the purposes and intent of Chapter 2.1 <br />of Title 62.1 of the Code of Virginia and of this Article, the <br />Wetlands Board shall deny the permit application with leave to <br />the applicant to resubmit the application in modified form. <br /> <br />Section 40-311. Permits; form. <br /> <br /> The permit shall be in writing, signed by the chairman of' <br />the Wetlands Board and notarized. <br /> <br />Section 40-312. Expiration date and extension. <br /> <br /> No permit shall be granted without an expiration date, <br />and the Wetlands Board, in the exercise of its discretion, <br />shall designate an expiration date for completion of such work <br />specified in the permit from the date the Wetlands Board <br />granted such permit. The Wetlands Board, however, may, upon <br />proper application therefor, grant extensions. <br /> <br />Section 40-313. Permits; effect on zoning. <br /> <br /> No permit granted by the Wetlands Board shall affect in <br />any way the applicable zoning and land use ordinances of the <br />City. <br /> <br />Section 40-314. Investigations and prosecutions. <br /> <br /> The Wetland Boards shall have the authority to <br />investigate all projects wh~ they are proposed or ongoing <br />which alter wetlands located~within the City. The Wetlands <br />Board shall have the power to prosecute all violations of any <br />order, rule or regulation of the Board or any violation of any <br />provision of Chapter 2.1 of Title 62.1 of the Code of Virginia <br />or of this Article. <br /> <br />Section 40-315. Violation of orders, rules and regulations. <br /> <br /> Any person who knowingly, intentionally, negligently or <br />continually violates any order, rule or regulation of the <br />Commission or of the Wetlands Board or violates any p~ovision <br />of Chapter 2.1 of Title 62.1 of the Code of Virginia or of the <br />provisions contained in this Article or any provision of a <br />permit Granted by the Wetlands Board or the Commission <br />pursuant to Chapter 2.1 of Title 62.1 of the Code of Virginia, <br />shall be guilty of a misdemeanor. Following a conviction, <br />every day the violation continues shall be deemed a separate <br /> offense. <br /> <br /> <br />
