1988-96 <br /> <br />AN ORDINANCE TO AMEND CHAPTER 23 OF THE CODE OF THE CITY OF <br />PORTSMOUTH, VIRGINIA, 1973, BY AMENDING SECTION 23-405 <br />THEREOF, AND BY ENACTING SECTION 23-405.1, THERETO, <br />PERTAINING TO MOTOR VEHICLES. <br /> <br /> BE IT ORDAINED by the Council of the City of Portsmouth, <br />Virginia, that: <br /> <br /> 1. Section 23-405 of the Code of the City of Portsmouth <br />be amended to read as follows: <br /> <br />Section 23-405. Construction, maintenance and loading to <br /> prevent escape of contents. <br /> <br /> No vehicle shall be operated or moved on any street or <br />highway within the City unless such vehicle is so <br />constructed, maintained, and loaded as to prevent its <br />contents from dropping, sifting, leaking or otherwise <br />escaping therefrom; provided, however that no provision of <br />this section shall apply (a) to any motor vehicle which is <br />used exclusively for agricultural purposes and which is not <br />operated on or over any public highway or street for any <br />other purpose other than the purpose of operating it across a <br />highway or street or along a highway or street from one point <br />of the owner's land to another part thereof irrespective of <br />whether the tracts adjoin; (b) to any agricultural vehicle, <br />tractor or other vehicle exempted from registration and <br />licensing requirements pursuant to ~46.1-45 of the Code of <br />Virginia, 1950, as amended; or (c) to any motor vehicle <br />transporting poultry or livestock. <br /> <br /> 2. That Section 23-405.1 of the Code of the City of <br />Portsmouth be enacted to read as follows: <br /> <br />Section 23-405.1. Securing or covering of contents of <br /> certain vehicles. <br /> <br /> The loads of all trucks, trailers and semitrailers, <br />carrying gravel, sand, or other nonagricultural and non <br />forestry products on interstate, primary or secondary <br />highways or on streets or roads maintained by the City shall <br />be either (a) secured to the vehicle in which they are being <br />transported or (b) covered. Public service company vehicles, <br />pickup trucks, coal trucks, and emergency snow removal <br />equipment while engaged in snow removal operations shall be <br />excluded from the provisions of this section. <br /> <br /> <br />
