AN ORDINANCE TO AMEND CHAPTER 38 OF THE CODE OF THE CITY OF <br />PORTSMOUTH, VIRGINIA, 1973, BY REPEALING SECTIONS 38-100 <br />THROUGH 38-118; AND AMENDING SECTION 38-77 AND 38-83, <br />THEREOF, PERTAINING TO CHARGES FOR SEWER SERVICE. <br /> <br /> BE IT ORDAINED by the Council of the City of Portsmouth, <br />Virginia, that: <br /> <br /> 1. Sections 38-100 through 38-118, both inclusive, of <br />the Code of the City of Portsmouth, be, and the same hereby <br />are, repealed. <br /> <br /> 2. That Section 38-77 of the Code of the City <br />of Portsmouth be amended by adding thereto subsection(f) <br />read as follows: <br /> <br />to <br /> <br />Paragraph 38-77(f). Charges for service established. <br /> <br /> (f) For the purposes of this chapter, "City Sewer <br />Disposal Service" or "sewage system" shall be defined as any <br />appurtenance of that integrated regional system of sewer <br />collection, transmission or treatment, whether located within <br />or without the boundaries of the City~ which has been, or is <br />intended to be, installed, operated or maintained by the <br />City, or in the installation, operation or maintenance of <br />which the City has participated, is participating or intends <br />to participate financially. <br /> <br /> 3. That Section 38-83 of the Code of the City of <br />Portsmouth be amended to read as follows: <br /> <br />Section 38-83. Additional fees and charges; fees for <br /> removal of obstruction. <br /> <br /> If the drainage or discharge from any establishment or <br />premises, whether residential, commercial or industrial, <br />causes a deposit, obstruction or damage, or contains <br />characteristics which add unduly to the cost of maintenance <br />and operation to any of the City's waste water facilities, <br />which includes but is not limited to manholes, and water and <br />sewer lines, and the surfaces including streets and <br />rights-of-way above, below and around said facilities, the <br />City may commence an action for appropriate legal and/or <br />equitable relief to assure the abatement of such drainage or <br />discharge. In addition thereto, the Director of Public <br />Utilities shall cause the deposit or obstruction to be <br />promptly removed or cause the damage to be promptly repaired. <br />The cost of such work, including materials, labor, overhead <br />and supervision, whether such work is performed by the City <br />of Portsmouth or by an outside contractor, shall be born by <br />such person causing or contributing to such deposit, <br />obstruction or damage, or by the owner of the premises <br /> <br /> <br />
