63 A RESOLUTION GRANTING A USE PERMIT TO MRS. JUDITH FAGAN TO OPERATE A PRIVATE PRESCHOOL AND DAYCARE CENTER TO BE KNOWN AS THE KITTREDGE SCHOOL AT 4401 HATTON POINT ROAD (UP-88-12). WHEREAS, Mrs. Judith Fagan, Director of Kittredge School, has made application pursuant to ~40-73 (~) for a use permit to operate a private preschool and daycare center at 4401 Hatton Point Road; and WHEREAS, the applicant and the Planning Director have done all things required to be done in connection with said application; and WHEREAS, the Planning Commission has recommended the granting of a use permit with conditions. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: 1. That the use for which the use permit is sought: (a) Will not adversely affect the health and safety of persons residing in the neighborhood of the proposed use; injurious and (b) Will not be detrimental to the public use or to the property or improvements in the neighborhood; (c) Will be in accord with the purposes of the Zoning Chapter of the City Code. 2. Mrs. Judith Fagan is hereby granted a use permit pursuant to ~40-73 (b) to operate a private preschool and daycare center known as the Kittredge School at 4401 Hatton Point Road, which property is leased from Temple Sinai, said property being further described as Tax Map 749, Parcel 4 (UP-88-12). 3. This use permit is approved subject to the following conditions: (a) No more than 45 students are to be in attendance at this facility at any one time. (b) Ail health, fire and building codes must be met prior to commencement of operation of this facility. (c) kll outdoor activities shall be conducted between the hours of 9:00 a. m. and 12:00 noon. (d) The applicant shall comply with all applicable codes, ordinances, policies and regulations of federal, state, and local governments and shall obtain all necessary licenses
