63 <br /> <br />A RESOLUTION GRANTING A USE PERMIT TO MRS. JUDITH FAGAN TO <br />OPERATE A PRIVATE PRESCHOOL AND DAYCARE CENTER TO BE KNOWN AS <br />THE KITTREDGE SCHOOL AT 4401 HATTON POINT ROAD (UP-88-12). <br /> <br /> WHEREAS, Mrs. Judith Fagan, Director of Kittredge School, <br />has made application pursuant to ~40-73 (~) for a use permit <br />to operate a private preschool and daycare center at 4401 <br />Hatton Point Road; and <br /> <br /> WHEREAS, the applicant and the Planning Director have <br />done all things required to be done in connection with said <br />application; and <br /> <br /> WHEREAS, the Planning Commission has recommended the <br />granting of a use permit with conditions. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City <br />of Portsmouth, Virginia: <br /> <br />1. That the use for which the use permit is sought: <br /> <br /> (a) Will not adversely affect the health and safety <br />of persons residing in the neighborhood of the proposed use; <br /> <br />injurious <br />and <br /> <br />(b) Will not be detrimental to the public use or <br />to the property or improvements in the neighborhood; <br /> <br /> (c) Will be in accord with the purposes of the <br />Zoning Chapter of the City Code. <br /> <br /> 2. Mrs. Judith Fagan is hereby granted a use permit <br />pursuant to ~40-73 (b) to operate a private preschool and <br />daycare center known as the Kittredge School at 4401 Hatton <br />Point Road, which property is leased from Temple Sinai, said <br />property being further described as Tax Map 749, Parcel 4 <br />(UP-88-12). <br /> <br /> 3. This use permit is approved subject to the following <br />conditions: <br /> <br /> (a) No more than 45 students are to be in <br />attendance at this facility at any one time. <br /> <br /> (b) Ail health, fire and building codes must be met <br />prior to commencement of operation of this facility. <br /> <br /> (c) kll outdoor activities shall be conducted <br />between the hours of 9:00 a. m. and 12:00 noon. <br /> <br /> (d) The applicant shall comply with all applicable <br />codes, ordinances, policies and regulations of federal, state, <br />and local governments and shall obtain all necessary licenses <br /> <br /> <br />
