61 A RESOLUTION AMENDING THE USE PERMIT GRANTED LA PETITE ACADEMY, INC. TO OPERATE A CHILDCARE CENTER AT 3907 CEDAR LANE. WHEREAS, Dennis Williams, Project Manager for La Petite, Academy, Inc., has made application pursuant to ~40-75 (b) of the Code of the City of Portsmouth, 1973, for the amending of the use permit granted by the Council of the City of Portsmouth, Virginia on November 24, 1987 to operate a childcare center at 3907 Cedar Lane; and WHEREAS, the applicant and the Planning Director have done all things required to be done in connection with said application; and WHEREAS, the Planning Commission has recommended the conditional granting of a use permit for the operation of childcare center. a NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: 1. That the use for which the use permit is sought: (a) Will not adversely affect the health and safety of persons residing or working in the neighborhood of the proposed use; injurious and (b) Will not be detrimental to the public use or to the property or improvements in the neighborhood; (c) Will be in acccrdance with the purposes of the Zoning Chapter of the City Code. 2. La Petite Academy, Inc.'s Use Permit (UP-87-23) granted November 24, 1987 by the Council of the City of Portsmouth, Virginia pursuant to ~40-75 (b) of the Code of the City o~ Portsmouth, Virginia, 1973, to operate a childcare center at 3907 Cedar Lane (Tax Map 721, Parcel 3.1) is hereby amended (UP-88-10). 3. This use permit is amended subject to the following conditions: (a) That all terms and conditions of the use permit as approved by Resolution No. 1987-110 adopted by the Council of the City of Portsmouth,. Virginia, at a meeting held November 24, 1987, shall remain in full force and effect except as revised in paragraph 3 (b) hereof.
