47 <br /> <br />A RESOLUTION GRANTING A USE PERMIT TO JAMES S. AND OLLIE C. <br />WILKINS FOR THE OPERATION OF GASOLINE PUMPS IN CONJUNCTION <br />WITH A WILCO MART CONVENIENCE STORE AT 1544 HIGH STREET. <br /> <br /> WHEREAS, James S. and Ollie C. Wilkins, by Arthur T. <br />Williams, III, representative for A. T. Williams Oil Company, <br />has made application pursuant to ~40-121 (a) (vii) of the Code <br />of the City of Portsmouth, Virginia, 1973, for the granting of <br />a use permit as hereinafter-described; and <br /> <br /> WHEREAS, the applicant and the Planning Director have <br />done all things required to be done in connection with said <br />application; and <br /> <br /> WHEREAS, the Planning Commission has recommended the <br />granting of said use permit with conditions. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City <br />of Portsmouth, Virginia: <br /> <br /> 1. That the use for which the use permit <br />hereinafter-described is sought: <br /> <br /> (a) will not adversely affect the health and safety <br />of persons residing or working in the neighborhood of the <br />proposed use; <br /> <br /> (b) Will not be detrimental no the public use or <br />injurious to the property or improvements of the neighborhood; <br />and <br /> <br /> (c) Will be in accordance with the purposes of the <br />Zoning Chapter of the City Code. <br /> <br /> 2. James S. Wilkins and Ollie C. Wilkins are here~y <br />granted a use permit pursuant to ~40-121 (a) (vii) of the Code <br />of the City of Portsmouth, Virginia, 1973, for the operation <br />of gasoline pumps in conjunction with a WILCO Mart Convenience <br />Store on property located at 1544 High Street and being more <br />particularly described as Tax Map 48, Parcel 168 (UP-88-8). <br /> <br /> 3. This use permit is approved subject to the following <br />condition: <br /> <br /> (a) Any modification, alteration, reconstruction, <br />construction, repair or maintenance activity of the structure, <br />gas pumps or other improvements on the premises must be <br />submitted to the Downtown Design Committee for review and <br />approval in accordance with Article VI of Chapter 40 of the <br />Code of the City of Portsmouth, Virginia prior to commencement <br />of the use of the premises for the herein above-described use. <br /> <br /> <br />
