46 <br /> <br />A RESOLUTION GRANTING A USE PERMIT TO THE PORTSMOUTH COMMUNITY <br />SERVICES BOARD TO OPERATE A GROUP RESIDENCE FOR SUBSTANCE <br />ABUSE REHABILITATION AND TREATMENT AT 750 CLIFFORD STREET. <br /> <br /> WHEREAS, David M. Norman, Executive Director, Portsmouth <br />Community Services Board, has made application pursuant to <br />~40-121 (a) (i) of the Code of the City of Portsmouth, <br />Virginia, as amended, for the granting of a use permit as <br />hereinafter-described; and <br /> <br /> WHEREAS, the applicant and the Planning Director have <br />done all things required to be done in connection with said <br />application; and <br /> <br /> WHEREAS, the Planning Commission has recommended the <br />granting of said use permit, with conditions. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City <br />of Portsmouth, Virginia: <br /> <br />I. That the use for which the use permit is sought: <br /> <br /> (a) Will not affect the health and safety of <br />persons residing or working in the neighborhood of the <br />proposed use; <br /> <br />injurious <br />and <br /> <br />(b) Will not be detrimental to <br />to the property or improvements <br /> <br />the public use or <br />in the neighborhood; <br /> <br /> (c) Will be in accord with the purposes of the <br />Zoning Chapter of the City Code. <br /> <br /> 2. The Portsmouth Community Services Board is hereby <br />granted a use permit pursuant to §40-12] (a) (i) of the Code <br />of the City of Portsmouth, Virginia, to operate a group home <br />for adults for thirty-two (32) residents for substance abuse <br />rehabilitation and treatment at 750 Clifford Street (UP-88-9). <br /> <br /> 3. This use permit is approved subject to the following <br />conditions: <br /> <br /> (a) Occupancy is limited to thirty-two (32) <br />residents. <br /> <br /> (b) Off-street parking must be provided to <br />accommodate the staff of the facility. <br /> <br /> (c) The use permit IS granted to the Portsmouth <br />Community Services Board and/or their designee for a substance <br />abuse rehabilitation and treatment facility and is not <br />transferable to any other person or entity. <br /> <br /> <br />
