46 A RESOLUTION GRANTING A USE PERMIT TO THE PORTSMOUTH COMMUNITY SERVICES BOARD TO OPERATE A GROUP RESIDENCE FOR SUBSTANCE ABUSE REHABILITATION AND TREATMENT AT 750 CLIFFORD STREET. WHEREAS, David M. Norman, Executive Director, Portsmouth Community Services Board, has made application pursuant to ~40-121 (a) (i) of the Code of the City of Portsmouth, Virginia, as amended, for the granting of a use permit as hereinafter-described; and WHEREAS, the applicant and the Planning Director have done all things required to be done in connection with said application; and WHEREAS, the Planning Commission has recommended the granting of said use permit, with conditions. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: I. That the use for which the use permit is sought: (a) Will not affect the health and safety of persons residing or working in the neighborhood of the proposed use; injurious and (b) Will not be detrimental to to the property or improvements the public use or in the neighborhood; (c) Will be in accord with the purposes of the Zoning Chapter of the City Code. 2. The Portsmouth Community Services Board is hereby granted a use permit pursuant to §40-12] (a) (i) of the Code of the City of Portsmouth, Virginia, to operate a group home for adults for thirty-two (32) residents for substance abuse rehabilitation and treatment at 750 Clifford Street (UP-88-9). 3. This use permit is approved subject to the following conditions: (a) Occupancy is limited to thirty-two (32) residents. (b) Off-street parking must be provided to accommodate the staff of the facility. (c) The use permit IS granted to the Portsmouth Community Services Board and/or their designee for a substance abuse rehabilitation and treatment facility and is not transferable to any other person or entity.
