43 <br /> <br />A RESOLUTION GRANTING APPROVAL FOR A GROUP HOUSING PROJECT <br />PURSUANT TO SECTION 40-55 OF THE CODE OF THE CITY OF <br />PORTSMOUTH, VIRGINIA, 1973, SAID PROJECT CONSISTING OF 17 <br />APARTMENT UNITS AT 3711 TURNPIKE ROAD AND DESIGNATED AS <br />GHP-88-4. <br /> <br /> WHEREAS, Evans, Johnson, Majer and Stewart Associates has <br />made application pursuant to §40-55 of the Code of the City of <br />Portsmouth, Virginia, 1973, for the granting and approval of a <br />group housing project consisting of seventeen (17) apartment <br />units at 3711 Turnpike Road; and <br /> <br /> WHEREAS, the application has been determined by the <br />Planning Commission to have met the requirements of S40-55 of <br />the Code of ~he City of Portsmouth, Virginia; and <br /> <br /> WHEREAS, the Planning Commission has reviewed such <br />application and site plan submitted therewith and has <br />recommended conditional approval of said application; and <br /> <br /> WHEREAS, the developer has been informed that approval of <br />the group housing project pursuant to ~40-55 grants only an <br />exempmion from certain requirements for residences as stated <br />in said section and does not constitute a waiver of any other <br />requirement embodied in the Subdivision Ordinance, Zoning <br />Ordinance, Code of the City of Portsmouth, Virginia, or any <br />other applicable local, stane or federal law or regulation; <br />and <br /> <br /> WHEREAS, the developer is aware that building permits or <br />any other required permit will be issued only upon compliance <br />with the ordinances, laws or regulations applicable thereto. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City <br />of Portsmouth, Virginia that t~e certain group housing p~oject <br />consisting of seventeen (17) apartment units at 3711 Turnpike <br />Road (Tax Plate 339, Parcel 10) which contains approximately <br />0.75 acres and designated as GHP-88-4, such project being more <br />specifically described in correspondence from the effice of <br />Dan E. Griffin, Kenneth Mo Sedlacko, Architects, A.I.A, Ltd. <br />as shown on plans designated for "Kingman Place Apartments", <br />the project consisting of thirteen (13) two bedroom and four <br />(4) three bedroom units, such correspondence and plans being <br />made a part hereof~ is hereby granted.approval subject to the <br />following terms and conditions: <br /> <br /> (1) A solid eight (8') foot high wood fence must be <br />erected around the east and north property lines and a four <br />(4') foot high wood fence must be erected on the west property <br />line from Turnpike Road approximately 190 + feet with an <br />eight (8') foot high wood fence from said point along the west <br />property line to the north property line. <br /> <br /> <br />
