42 <br /> <br />A RESOLUTION GRANTING APPROVAL FOR A GROUP HOUSING PROJECT <br />PURSUANT TO SECTION 40-55 OF THE CODE OF THE CITY OF <br />PORTSMOUTH, VIRGINIA, 1973, SAID PROJECT CONSISTING OF 28 <br />APARTMENT UNITS ON A 2.05 ACRE PARCEL ON ANSELL AVENUE AND <br />DESIGNATED AS GHP-88-3. <br /> <br /> WHEREAS, Tedford Development Company by Vernon Duncan has <br />made application pursuant to Section 40-55 of the Code of the <br />City of Portsmouth, Virginia, 1973, as amended, for the <br />granting and approval of a group housing project consisting of <br />twenty-eight (28) apartment units on a 2.05 acre parcel on <br />Ansell Avenue (Tax Map 465, Parcels 38 and 39) adjacent to the <br />Town and Country Apartments to be known as "Town and Country <br />Apartments, Phase II", such group housing project having been <br />designated as GHP-88-3; and <br /> <br /> WHEREAS, the application has been determined by the <br />Planning Commission to have met the requirements of Section <br />40-55; and <br /> <br /> WHEREAS, the Planning Commission has reviewed such <br />application and site plan submitted therewith and has <br />recommended conditional approval of said application; and <br /> <br /> WHEREAS, the developer has been informed that approval of <br />a group housing project pursuant to Section 40-55 grants only <br />an exemption from certain requirements for residences as <br />stated in said section and does not constitute a waiver of any <br />other requirement embodied in the Subdivision Ordinance, <br />Zoning Ordinance, Code of the City of Portsmouth, Virginia, or <br />any other applicable local, state or federal law or <br />regulation; and <br /> <br /> WHEREAS, the developer ~i~[a~are that building permits or <br />any other required permit willY,be issued only upon compliance <br />with the ordinances, laws or regulations applicable thereto. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City <br />of Portsmouth, Virginia, that the certain group housing <br />project consisting of twenty-eight (28) apartment units <br />located on a 2.05 acre parcel on Ansell Avenue (Tax Map 465, <br />Parcels 38 and 39) to be known as "Town and Country <br />Apartments, Phase II" and designated as (GHP-88-3) and more <br />specifically described in documentation and plans filed with <br />the appropriate officials of the City of Portsmouth, Virginia, <br />such documentation and plans being made a part hereof, is <br />hereby granted approval subject to the following terms and <br />conditions: <br /> <br /> (1) A site improvement plan must be submitted to the <br />Engineering and Technical Services Department for review and <br />approval. <br /> <br /> <br />
