31 <br /> <br />A RESOLUTION GRANTING APPROVAL FOR A GROUP HOUSING PROJECT <br />PURSUANT TO SECTION 40-55 OF THE CODE OF THE CITY OF <br />PORTSMOUTH, VIRGINIA, 1973, AS AMENDED, SAID PROJECT BEING <br />LOCATED ON 10 ACRES OF PROPERTY OF THE FORMER BEASLEY FARM <br />SITE AND CONSISTING OF 86 TOWNHOUSE UNITS AND DESIGNATED AS <br />GHP-88-2. <br /> <br /> WHEREAS, Garcia-Gelardi Development Corporation has made <br />application pursuant to S40-55 of the Code of the City of <br />Portsmouth, Virginia, 1973, as amended, for the granting and <br />approval of a group housing project consistiag of eighty-six <br />(86) townhouse units on Parcel 4-C of the Riverpoint <br />Subdivision, such parcel being approximately 10 acres of <br />property on the northern portion of the ~former Beasley Farm <br />and designated as GHP-88-2, such parcel being a portion of <br />Parcel 4 in Zoning kmendment Ordinance Z-85-21; and <br /> <br /> WHEREAS, the applicant has been determined by the <br />Planning Commission to have met the requirements of ~40-55 of <br />the Code of the City of Portsmouth, Virginia 1973, as amended; <br />and <br /> <br /> WHEREAS, the Planning Commission has reviewed such <br />application and site plans submitted therewith and has <br />recommended conditional approval of said application; and <br /> <br /> WHEREAS, the developer has been informed that approval of <br />a group housing project pursuant to ~40-55 grants only an <br />exemption from certain requirements for residences as stated <br />in said section and does not constitute a waiver of any other <br />requirement embodied in the Subdivision Ordinance, Zoning <br />Ordinance, Code of the City of Portsmouth, Virginia, or any <br />other applicable local, state or federal law or regulation; <br />and : . · <br /> <br /> WHEREAS, the developer is aware that building permits or <br />any other required permit will be issued only upon compliance <br />with the ordinances, laws or regulations applicable thereto. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City <br />of Portsmouth, Virginia, that the certain group housing <br />project designated as GHP-88-2 and being more specifically <br />described in correspondence from the ESG Companies dated <br />February 23, 1988 as shown on plans filed with the appropriate <br />officials of the City of Portsmouth, such correspondence and <br />plans being made a part hereof, is hereby granted approval <br />subject to the following terms and conditions: <br /> <br /> (1) A landscape plan showing low to medium height <br />deciduous shrubs and evergreens in front of the townhouse <br />units must be submitted for review and approval by the <br />Planning bepartment prior to issuance of building permits. <br /> <br /> <br />
