30 A RESOLUTION GRANTING A USE PERMIT TO APACHE-BLAST, INC. TO OPERATE A COAL SLAG PROCESSING PLANT AT 3310 GEORGE WASHINGTON HIGHWAY. WHEREAS, Richard S. Couch, Vice President of Apache-Blast, Inc., has made application pursuant to Section 40-69 (b) of the Code of the City of Portsmouth, Virginia, 1973, for the granting of a use permit as hereinafter-described; and WHEREAS, the applicant and the Planning Director have done all things required to be done in connection with said application; and WHEREAS, the Planning Commission has recommended the granting of said use permit, with conditions. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: 1. That the use for which the use permit hereinafter-described is sought: (a) Will not adversely of persons mesiding or working in proposed use; affect the health and safety the neighborhood of the injurious and (b) Will not be detrimental to the public use or to the property or improvements in the neighborhood; (c) Will be in accordance with the purposes of the Zoning Chapter of the City Code. 2. Apache~Blast, In~. is hereby granted a use permit pursuann to Section 40-69 (b) of the Code of the City of Portsmouth to operate a coal slag processing plant on 9.180 acres at 3310 George Washington Highway, such parcel being more specifically described as Tax Map 133, Parcel 9 (UP-88-7). 3. This use permit is approved subject to the following conditions: (1) Ail required local, state and federal permits, including but not limited to, a permit from the State Air Pollution Control Board, must be obtained prior to commencement of operation. (2) The Company will operane during the hours of 8:00 a. m. to 6:00 p. m. on Monday through Saturday.
