52 <br /> <br />A RESOLUTION GRANTING APPROVAL FOR A GROUP HOUSING PROJECT <br />PURSUANT TO SECTION 40-55 OF THE CODE OF THE CITY OF <br />PORTSMOUTH, VIRGINIA, 1988, SAID PROJECT CONSISTING OF 80 <br />MULTI-FAMILY RESIDENTIAL UNITS ON 5.28 ACRES OF LAND ON THE <br />SOUTH SIDE OF GATEWAY DRIVE AND DESIGNATED AS GHP-89-5. <br /> <br /> WHEREAS, J. Gregory Dodd, on behalf of Westwinds <br />Associates and Newman Associates, has made application <br />pursuant to §40-55 of the Code of the City of Portsmouth, <br />Virginia, 1988, as amended, for the granting and approval of a <br />group housing project consisting of eighty (80) multi-family <br />residential units on a 5.28 acre parcel on the south side of <br />Gateway Drive, such parcel being further described as Parcel <br />10 in Zoning Ordinance Amendment Z-89-4, such group housing <br />project having been designated as GHP-89-5; and <br /> <br /> WHEREAS, the application has been determined by the <br />Planning Commission to have met the requirements of ~40-55 of <br />the Code of the City of Portsmouth, Virginia, 1988, as <br />amended, and the Planning Commission has reviewed such <br />application and site plans submitted therewith and has <br />recommended a conditional approval of said application; and <br /> <br /> WHEREAS, the developer has been informed that the <br />approval of a group housing project pursuant to §40-55 grants <br />only an exemption from certain requirements for residences as <br />stated in said section and does not constitute a waiver of any <br />other requirement embodied in the Subdivision Ordinance, <br />Zoning Ordinance, Code of the City of Portsmouth, Virginia, or <br />any other applicable local, state or federal law or <br />regulation; and <br /> <br /> WHEREAS, the developer is aware <br />or any other required permit will be <br />compliance with the ordinances, laws <br />applicable thereto. <br /> <br />that the building <br />issued only upon <br />and regulations <br /> <br />permits <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City <br />of Portsmouth, Virgihia, that the certain group housing <br />project designated as GHP-89-5 and more specifically described <br />on plans filed with the appropriate officials of the City of <br />Portsmouth, Virginia, such plans and documentations in support <br />thereof being made a part hereof is hereby granted approval <br />subject to the following terms and conditions: <br /> <br /> (1) The group housing project shall be limited to a <br />maximum of eighty (80) multi-family residential units. <br /> <br /> (2) A subdivision plat vacating the property line <br />adjacent to Westwinds I must be approved and recorded prior <br />the issuance of any building permits. <br /> <br />to <br /> <br /> <br />
