51 <br /> <br />A RESOLUTION GRANTING APPROVAL FOR A GROUP HOUSING PROJECT <br />PURSUANT TO SECTION 40-55 OF THE CODE OF THE CITY OF <br />PORTSMOUTH, VIRGINIA, 1988, CONSISTING OF THREE CONDOMINIUM <br />UNITS AT 348 HAMILTON AVENUE. <br /> <br /> WHEREAS, Charles E. Willett, Sr., has made application <br />pursuant to Section 40-55 of the Code of the City of <br />Portsmouth, Virginia, 1988, as amended, for the granting and <br />approval of a group housing project consisting of three <br />condominium units to be developed at 348 Hamilton Avenue in <br />the Port No~folk Historic District, such premises further <br />described as tax map 178, parcel 3.1, and such group housing <br />project having been designated as GHP-89-4 and consisting of <br />two-three bedroom units and one-two bedroom unit (1600 and <br />1364 square feet respectively), on the property; and <br /> <br /> WHEREAS, the application has been determined by the <br />Planning Commission to have met the requirements of Section <br />40-55 of the Code of the City of Portsmouth, Virginia, 1988, <br />as amended, and the Planning Commission has reviewed such <br />application and site plan submitted therewith and has <br />recommended a conditional approval of said application; and <br /> <br /> WHEREAS, the developer has been informed that approval of <br />a group housing project pursuant to Section 40-55 grants only <br />an exemption from certain requirements for residents as stated <br />in said section, and does not constitute a waiver of any other <br />requirement embodied in the subdivision ordinance, zoning <br />ordinance, code of the City of Portsmouth, or any other <br />applicable local, state or federal law or regulations; and <br /> <br /> WHEREAS, the developer is aware that building permits or <br />any other required permits be issued only upon compliance with <br />the ordinances, laws, or regulations applicable thereto. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City <br />of Portsmouth, Virginia, that the certain group housing <br />project described above and designated as GHP-89-4 and most <br />specifically described by correspondence from Charles E. <br />Willett, Sr., as shown on the plan filed with the appropriate <br />officials of the City of Portsmouth, Virginia, such <br />correspondence and plans being made a part hereof, is hereby <br />granted approval subject to the following terms and <br />conditions: <br /> <br />Any retention walls or other bank stabilization <br />structures must be constructed landward of any <br />wetlands as defined in Section 39-23 of the City <br />Code. <br /> <br />2. Drainage must be designed to minimize storm watsr <br /> runoff impacts on the wetlands. <br /> <br /> <br />
