!44 A RESOLUTION GRANTING A USE PE~{IT TO JANUARY 16TH ASSOCIATES FOR AN AUTOMOTIVE SERVICE STATION INCLUDING GASOLINE PUMPS AND A CAR WASH IN CONJUNCTION WITH A CONVENIENCE STORE ON THE WEST SIDE OF TOWNE POINT ROAD SOUTH OF BICKFORD PARKWAY. WHEREAS, January 16th Associates have made application pursuant to S40-70 (b) of the Code of the City of Portsmouth, Virginia, 1988, for the granting of a use permit as hereinafter-described; and WHEREAS, the applicant and the Planning Director have done all things required to be done in connection with said application; and WHEREAS, the Planning Commission has recommended the granting of said use permit with conditions. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: 1. That the use for which the use permit hereinafter~described is sought: (a) Will not adversely affect the health and safety of persons residing or working in the neighborhood of the proposed use; injurious and (b) Will not be detrimental to the public use or to the propertY or improvements of the neighborhood; (c) Will be in accordance with the purposes of the Zoning Chapter of the City Code. 2. January 16th Associates is hereby granted a use permit pursuant to ~40-70 (b) of the Code of the City of Portsmouth, Virginia, 1988, for an automotive service station including gasoline pumps and car wash in conjunction with a convenience store on the property on the west side of Towne Point Road lying south of Bickford Parkway, such property being more particularly described as follows: UP-89-5 BEGINNING at the southeast intersection of Towne Point Road and Bickford Parkway (relocated); thence west along the south right-of-way of Bickford Parkway 150', more or less; thence southerly 150', thence east 150',
